  1.1                          A bill for an act 
  1.2             relating to local government; providing for 
  1.3             disposition of certain towns; proposing coding for new 
  1.4             law in Minnesota Statutes, chapter 414. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [414.066] [DISPOSITION OF CERTAIN TOWNS.] 
  1.7      Subdivision 1.  [TOWNS OVER 2,500.] If a town has a 
  1.8   population of 2,500 or more according to the decennial federal 
  1.9   census in 2000, or later, the Minnesota municipal board shall, 
  1.10  within six months, conduct a hearing and issue an order for the 
  1.11  town's transition into a city.  The order shall provide for an 
  1.12  election to determine the form of government from among the 
  1.13  options for statutory cities and set a date for the election and 
  1.14  a later date for the effective date of the transition not more 
  1.15  than one year after the municipal board's order.  The order may 
  1.16  provide for other necessary and appropriate matters. 
  1.17     Subd. 2.  [TOWNS UNDER 500.] If a town has a population of 
  1.18  fewer than 500 according to the decennial federal census in 
  1.19  2000, or later, the town is dissolved at the end of its current 
  1.20  fiscal year and it is merged with a contiguous city, if any, or 
  1.21  if more than one, the most appropriate contiguous city as 
  1.22  determined by the municipal board.  If there is no contiguous 
  1.23  city, the town is merged into the contiguous town in the same 
  1.24  county with the largest population, or, if no contiguous city or 
  1.25  town, the town is merged into the most appropriate contiguous 
  2.1   unorganized territory as determined by the municipal board.  If 
  2.2   by merger the resulting entity has a population of 2,500 or 
  2.3   more, subdivision 1 applies.  The municipal board may make other 
  2.4   provisions by order as are necessary and appropriate for the 
  2.5   transition.  
  2.6      Sec. 2.  [EFFECTIVE DATE.] 
  2.7      Section 1 is effective July 1, 1998.
