  1.1                          A bill for an act
  1.2             relating to traffic regulations; specifying duty of 
  1.3             care of bus drivers to passengers; proposing coding 
  1.4             for new law in Minnesota Statutes, chapter 169. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [169.2212] [BUS DRIVER DUTY OF CARE.] 
  1.7      The duty of care owed by a driver of a regular route 
  1.8   transit bus to a passenger on that bus, including a passenger 
  1.9   who is an elementary or secondary pupil, applies only when the 
  1.10  passenger is on the bus or boarding or disembarking.  The duty 
  1.11  of care owed by a driver of a paratransit vehicle to a passenger 
  1.12  on that vehicle, including a passenger who is an elementary or 
  1.13  secondary pupil, applies only when the passenger is on the 
  1.14  vehicle or boarding or disembarking, and as provided in the 
  1.15  local passenger assistance policy.  At all other times the 
  1.16  passenger is a pedestrian and a driver's duty is limited to the 
  1.17  duty of care owed by an operator of a motor vehicle to a 
  1.18  pedestrian.  For purposes of this section, "regular route 
  1.19  transit" has the meaning given it in section 174.22, subdivision 
  1.20  8, and "paratransit" has the meaning given it in section 174.22, 
  1.21  subdivision 6.
