A bill for an act
relating to consumer protection; requiring disclosures regarding gas fireplaces;
proposing coding for new law in Minnesota Statutes, chapter 325F.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Definitions. new text end

new text begin (a) For the purposes of this section, the terms in this
subdivision have the meanings given them.

new text begin (b) "Commissioner" means the commissioner of labor and industry.
new text end

new text begin (c) "Gas fireplace" means a vented fireplace that uses natural gas or liquefied petroleum
gas to operate.

new text begin (d) "Homeowner" means a person who owns legal or equitable interest in residential
real estate.

new text begin (e) "Prospective buyer" has the meaning given in section 513.52, subdivision 2.

new text begin (f) "Residential real estate" has the meaning given in section 326B.802, subdivision 13.

new text begin (g) "Residential remodeler" has the meaning given in section 326B.802, subdivision 12.

new text begin (h) "Seller" means a person who owns legal or equitable title to residential real estate
and intends to transfer the legal or equitable title via sale.

new text begin A disclosure, in form and substance acceptable to the commissioner,
regarding the dangers and appropriate safety precautions for a gas fireplace must be provided
by:

new text begin (1) a residential remodeler to a homeowner at least three days before a gas fireplace is
installed; and
new text end

new text begin (2) a seller to a prospective buyer as part of the seller disclosures under section 513.55,
subdivision 1, when a gas fireplace is part of the residential real estate.
