  1.1                          A bill for an act 
  1.2             relating to insurance; health; regulating childbirth 
  1.3             and postpartum care benefits; proposing coding for new 
  1.4             law in Minnesota Statutes, chapter 62A. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [62A.0411] [MATERNITY CARE.] 
  1.7      Every health plan as defined in section 62Q.01, subdivision 
  1.8   3, that provides maternity benefits must, consistent with other 
  1.9   coinsurance, copayment, deductible, and related contract terms, 
  1.10  provide coverage of a minimum of 48 hours of inpatient care 
  1.11  following a vaginal delivery and a minimum of 96 hours of 
  1.12  inpatient care following a caesarean section for a mother and 
  1.13  her newborn.  The health plan shall not provide any compensation 
  1.14  or other nonmedical remuneration to encourage a mother and 
  1.15  newborn to leave inpatient care before the duration minimums 
  1.16  specified in this section. 
  1.17     The health plan must also provide coverage for postdelivery 
  1.18  care to a mother and her newborn if the duration of inpatient 
  1.19  care is less than the minimums provided in this section. 
  1.20     Postdelivery care consists of a minimum of one home visit 
  1.21  by a registered nurse.  Services provided by the registered 
  1.22  nurse include, but are not limited to, parent education, 
  1.23  assistance and training in breast and bottle feeding, and 
  1.24  conducting any necessary and appropriate clinical tests.  The 
  1.25  home visit must be conducted within four days following the 
  2.1   discharge of the mother and her child. 
  2.2      Sec. 2.  [EFFECTIVE DATE; APPLICATION.] 
  2.3      Section 1 is effective the day following final enactment 
  2.4   and applies to health plans issued or renewed to provide 
  2.5   coverage to a Minnesota resident on or after that date.
