{\rtf1\ansi\deff0{\fonttbl{\f0 Times New Roman;}}\margl480\margr0\margt0\margb0\fs20\n\line \line\n\line \line\n\line \line\n\line {\pard\n\line \n\line \n\line 1.1 A bill for an act \n\line 1.2 relating to education; repealing and replacing the \n\line 1.3 profile of learning; providing for expedited \n\line 1.4 rulemaking; repealing certain portions of Minnesota \n\line 1.5 Rules, chapter 3501; proposing coding for new law in \n\line 1.6 Minnesota Statutes, chapter 120B. \n\line 1.7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: \n\line 1.8 Section 1. [120B.001] [REPEALING PROFILE OF LEARNING \n\line 1.9 STATUTES AND RULES AND RELATED STATEWIDE TESTING REQUIREMENT.] \n\line 1.10 {\ul (a) Notwithstanding sections 120B.02, 120B.031, 120B.30,} \n\line 1.11 {\ul 120B.31, and 120B.35, or other law to the contrary, the} \n\line 1.12 {\ul commissioner of children, families, and learning must not} \n\line 1.13 {\ul implement the profile of learning portion of the state's} \n\line 1.14 {\ul results-oriented graduation rule and all rules under Minnesota} \n\line 1.15 {\ul Rules, chapter 3501, related to the profile of learning portion} \n\line 1.16 {\ul of the state's results-oriented graduation rule described in} \n\line 1.17 {\ul this chapter are repealed.} \n\line 1.18 {\ul (b) The requirement under section 120B.30 for a test} \n\line 1.19 {\ul aligned with the profile of learning portion of the state's} \n\line 1.20 {\ul graduation standards that is administered annually to all} \n\line 1.21 {\ul students in grades 3, 5, 7, 8, 10, and 11 is repealed. This} \n\line 1.22 {\ul repeal does not apply to the state's basic skills tests in} \n\line 1.23 {\ul reading, mathematics, and written composition.} \n\line 1.24 [EFFECTIVE DATE.] {\ul Paragraph (a) of this section is} \n\line 1.25 {\ul effective the day following final enactment and applies to the} \n\line 1.26 {\ul 2003-2004 school year and later. Paragraph (b) of this section} \n\line 2.1 {\ul is effective immediately and applies to the 2004-2005 school} \n\line 2.2 {\ul year and later.} \n\line 2.3 Sec. 2. [REPLACING PROFILE OF LEARNING STATUTES AND \n\line 2.4 RULES.] \n\line 2.5 {\ul Subdivision 1.} [STAKEHOLDER ADVICE ON STANDARDS.] {\ul The} \n\line 2.6 {\ul commissioner of children, families, and learning must consider} \n\line 2.7 {\ul advice from at least the following stakeholders in developing} \n\line 2.8 {\ul statewide rigorous core academic standards in English,} \n\line 2.9 {\ul mathematics, science, and history and geography to replace the} \n\line 2.10 {\ul profile of learning:} \n\line 2.11 {\ul (1) parents of school-age children and members of the} \n\line 2.12 {\ul public throughout the state;} \n\line 2.13 {\ul (2) teachers throughout the state currently licensed and} \n\line 2.14 {\ul providing instruction in English, mathematics, science, or} \n\line 2.15 {\ul history and geography and licensed elementary and secondary} \n\line 2.16 {\ul school principals throughout the state currently administering a} \n\line 2.17 {\ul school site;} \n\line 2.18 {\ul (3) currently serving members of local school boards and} \n\line 2.19 {\ul charter school boards throughout the state;} \n\line 2.20 {\ul (4) faculty teaching core subjects at postsecondary} \n\line 2.21 {\ul institutions in Minnesota; and} \n\line 2.22 {\ul (5) representatives of the Minnesota business community.} \n\line 2.23 {\ul Subd. 2.} [PARAMETERS FOR ACADEMIC STANDARDS.] {\ul The academic} \n\line 2.24 {\ul standards must:} \n\line 2.25 {\ul (1) be based on factual, objective, verifiable knowledge in} \n\line 2.26 {\ul English, mathematics, science, and history and geography;} \n\line 2.27 {\ul (2) be clear, concise, measurable, and grade-level} \n\line 2.28 {\ul appropriate;} \n\line 2.29 {\ul (3) preserve and promote fundamental American principles} \n\line 2.30 {\ul stated in the Declaration of Independence and the Constitution} \n\line 2.31 {\ul of the United States and other such principles as national} \n\line 2.32 {\ul sovereignty, natural law, and free market enterprise;} \n\line 2.33 {\ul (4) not mandate a specific teaching methodology nor include} \n\line 2.34 {\ul work-based learning or any other content standard inconsistent} \n\line 2.35 {\ul with this subdivision; and} \n\line 2.36 {\ul (5) be assessed using tests aligned with the academic} \n\line 3.1 {\ul standards established under this section.} \n\line 3.2 {\ul Subd. 3.} [COMMISSIONER TO PRESENT PROPOSED RULES TO THE \n\line 3.3 LEGISLATURE.] {\ul (a) The commissioner must present to the} \n\line 3.4 {\ul legislature proposed rules for implementing statewide rigorous} \n\line 3.5 {\ul core academic standards in English, mathematics, science, and} \n\line 3.6 {\ul history and geography as follows:} \n\line 3.7 {\ul (1) by April 15, 2003, present proposed rules for} \n\line 3.8 {\ul implementing statewide rigorous core academic standards in} \n\line 3.9 {\ul English and mathematics;} \n\line 3.10 {\ul (2) present a statewide plan for students, educators,} \n\line 3.11 {\ul schools, and school districts to make the transition from the} \n\line 3.12 {\ul profile of learning to the standards described under this act;} \n\line 3.13 {\ul (3) by March 1, 2004, present proposed rules for} \n\line 3.14 {\ul implementing statewide rigorous core academic standards in} \n\line 3.15 {\ul science;} \n\line 3.16 {\ul (4) by March 1, 2005, present proposed rules for} \n\line 3.17 {\ul implementing statewide rigorous core academic standards in} \n\line 3.18 {\ul history and geography.} \n\line 3.19 {\ul (b) All proposed rules the commissioner presents must} \n\line 3.20 {\ul comply with the requirements of this section.} \n\line 3.21 {\ul (c) A school district, no later than the 2007-2008 school} \n\line 3.22 {\ul year, must incorporate into its existing locally established} \n\line 3.23 {\ul graduation requirements the state graduation requirements} \n\line 3.24 {\ul premised on rules proposed under this section. A school} \n\line 3.25 {\ul district that incorporates these state graduation requirements} \n\line 3.26 {\ul before the 2007-2008 school year must provide students who enter} \n\line 3.27 {\ul the ninth grade in or before the 2004-2005 school year with the} \n\line 3.28 {\ul opportunity to earn a diploma based on existing locally} \n\line 3.29 {\ul established graduation requirements in effect when the students} \n\line 3.30 {\ul entered the ninth grade. District efforts to develop,} \n\line 3.31 {\ul implement, or improve instruction or curriculum as a result of} \n\line 3.32 {\ul the provisions of this section must be consistent with Minnesota} \n\line 3.33 {\ul Statutes, sections 120B.10, 120B.11, and 120B.20.} \n\line 3.34 {\ul Subd. 4.} [RULES IMPLEMENTING READING AND MATH \n\line 3.35 STANDARDS.] {\ul The commissioner must adopt rules under Minnesota} \n\line 3.36 {\ul Statutes, section 14.388, clause (2), for implementing the} \n\line 4.1 {\ul statewide rigorous core academic standards in English and} \n\line 4.2 {\ul mathematics described in subdivision 3, clause (1).} \n\line 4.3 [EFFECTIVE DATE.] {\ul Subdivisions 1, 2, and 3 are effective} \n\line 4.4 {\ul the day following final enactment. Subdivision 4 is effective} \n\line 4.5 {\ul April 30, 2003.} \n\line 4.6 Sec. 3. [INTERIM ALTERNATIVE.] \n\line 4.7 {\ul If the legislature does not authorize the commissioner} \n\line 4.8 {\ul under section 2, subdivision 4, to adopt rules to implement} \n\line 4.9 {\ul statewide rigorous core academic standards in English and} \n\line 4.10 {\ul mathematics that are effective for the 2003-2004 school year,} \n\line 4.11 {\ul each school district and charter school shall continue to} \n\line 4.12 {\ul implement academic English and mathematics standards consistent} \n\line 4.13 {\ul with Minnesota Statutes 2002, section 120A.22, subdivision 9,} \n\line 4.14 {\ul until such rules to implement statewide rigorous core academic} \n\line 4.15 {\ul standards in English and mathematics are adopted.} \n\line 4.16 [EFFECTIVE DATE.] {\ul This section is effective the day} \n\line 4.17 {\ul following final enactment.}\n\line \n\line \par}
