A bill for an act
relating to human services; requiring drug tests as a condition of MFIP eligibility;
amending Minnesota Statutes 2006, section 256J.15, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 256J.15, is amended by adding a
subdivision to read:

new text begin (a) Beginning July 1, 2007, in order to be eligible for
assistance under this chapter, applicants must pass a drug test at the time of application
for assistance. Persons receiving assistance prior to July 1, 2007, must pass a drug test
at the next time of recertification of eligibility under section 256J.32, subdivision 6, as a
condition of continued eligibility and following any positive test for an illegal controlled
substance are subject to the sanctions under section 256J.26, subdivision 1, paragraph
(a), clauses (2) and (3).

new text begin (b) MFIP applicants and participants must pay for the cost of the drug test required
under paragraph (a), either up front or through an offset of future assistance under this
chapter.
