A bill for an act
relating to environment; adding an element to the commissioner of the Pollution
Control Agency's public education program; directing the governor to designate
Minnesota Cleanup Day; setting minimum criminal penalties for littering;
amending Minnesota Statutes 2006, sections 115A.072, subdivision 4; 609.68;
proposing coding for new law in Minnesota Statutes, chapter 115A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 115A.072, subdivision 4, is amended to
read:


Subd. 4.

Education, promotion, and procurement.

The commissioner shall
include: (1) waste reduction and reuse, including packaging reduction and reuse; deleted text begin anddeleted text end (2)
new text begin anti-littering; and (3) new text end the hazards of open burning, as defined in section 88.01, of mixed
municipal solid waste, especially the hazards of dioxin emissions to children, as elements
of the commissioner's program of public education on waste management required under
this section. The waste reduction and reuse education program must include dissemination
of information and may include an award program for model waste reduction and reuse
efforts. Waste reduction and reuse educational efforts must also include provision of
information about and promotion of the model procurement program developed by the
commissioner of administration under section 115A.15, subdivision 7, or any other model
procurement program that results in significant waste reduction and reuse.

Sec. 2.

new text begin The governor shall designate one day each year as Minnesota Cleanup Day and shall
encourage political subdivisions, civic organizations, nonprofit organizations, schools,
and private businesses to organize voluntary activities on that day to remove and lawfully
dispose of litter that has been deposited on the public and private lands and waters of
the state.

Sec. 3.

Minnesota Statutes 2006, section 609.68, is amended to read:


609.68 UNLAWFUL DEPOSIT OF GARBAGE, LITTER, OR LIKE.

Whoever unlawfully deposits garbage, rubbish, cigarette filters, debris from
fireworks, offal, or the body of a dead animal, or other litter in or upon any public highway,
public waters or the ice thereon, shoreland areas adjacent to rivers or streams as defined by
section 103F.205, public lands, or, without the consent of the owner, private lands or water
or ice thereon, is guilty of a petty misdemeanornew text begin and shall pay a fine of no less than $200new text end .
