A bill for an act
relating to transportation; establishing construction impact grant program;
appropriating money; proposing coding for new law in Minnesota Statutes,
chapter 161.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin For purposes of this section, the following terms have
the meanings given to them:

new text begin (a) "Road construction project" means construction, reconstruction, or maintenance
of a highway, town road, or municipal state-aid street.

new text begin (b) "Owner" means a property owner or business owner leasing a property.

new text begin The commissioner shall develop and implement a
construction impact grant program to provide grants as specified in this section. Eligible
recipients of a grant are owners, or owners on behalf of employees, for whom the
commissioner finds there is a reasonable expectation of adverse health effects due to a
road construction project. Grant funds may be used only for installation, construction,
maintenance, or repair projects on a building that directly address or mitigate adverse
health effects due to a road construction project.

new text begin The commissioner shall adopt rules governing the program,
including procedures for application for grants, conditions for their administration,
and criteria for priority, consistent with the requirements of this section. Criteria for
determining priorities and amounts of grants must be based on consideration of:

new text begin (1) effectiveness of the project in addressing or mitigating adverse health effects;
new text end

new text begin (2) number of persons affected by the project;
new text end

new text begin (3) cost of the project relative to its benefit; and
new text end

new text begin (4) availability of other financing.

new text begin This section is effective July 1, 2007.

Sec. 2. new text begin APPROPRIATION.

new text begin $....... is appropriated from the general fund to the commissioner of transportation
for the construction impact grant program under section 1. The appropriation may be used
for grants and for adopting rules.
