  1.1                          A bill for an act
  1.2             relating to education; authorizing summer school 
  1.3             funding for elementary pupils; amending Minnesota 
  1.4             Statutes 1996, section 124.17, subdivision 5. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1996, section 124.17, 
  1.7   subdivision 5, is amended to read: 
  1.8      Subd. 5.  [BASIC SKILLS SUMMER SCHOOL PUPIL UNITS.] (a) 
  1.9   When a pupil who has not passed an assessment of basic 
  1.10  graduation standards in reading, writing, or mathematics is 
  1.11  enrolled in a mastery of basic skills summer school program that 
  1.12  is not a part of the regular school term and the student has a 
  1.13  total enrollment time of more than 1,020 hours in a school year, 
  1.14  the pupil may be counted as more than one pupil in average daily 
  1.15  membership for purposes of this subdivision only.  The amount in 
  1.16  excess of one pupil must be determined by the ratio of the 
  1.17  number of hours of instruction provided to that pupil in excess 
  1.18  of 1,020 hours.  For each pupil, only the amount of summer 
  1.19  school enrollment time attributable to basic skills instruction 
  1.20  may be used to calculate the additional hours in the school 
  1.21  year.  Basic skills instruction is defined as in Minnesota's 
  1.22  rules on graduation standards and includes reading, writing, and 
  1.23  mathematics.  
  1.24     (b) An elementary pupil that is eligible for services under 
  1.25  the assurance of mastery program under section 124.311 may be 
  2.1   counted as more than one pupil in average daily membership for 
  2.2   purposes of this subdivision only.  The amount in excess of one 
  2.3   pupil must be determined by the ratio of the number of hours of 
  2.4   instruction provided to that pupil in excess of 935 hours. 
  2.5      (c) Hours that occur after the close of the instructional 
  2.6   year in June shall be attributable to the following fiscal 
  2.7   year.  A pupil for whom payment is made under this subdivision 
  2.8   may be counted by a district only for the computation of basic 
  2.9   revenue, according to section 124A.22, subdivision 2, minus $300.
  2.10     Sec. 2.  [EFFECTIVE DATE.] 
  2.11     Section 1 is effective the day following final enactment 
  2.12  and applies for fiscal year 1998.
