  1.1                          A bill for an act 
  1.2             relating to natural resources; transferring 
  1.3             responsibility for making drainage benefit payments on 
  1.4             state lands to the commissioner of finance; 
  1.5             appropriating money; amending Minnesota Statutes 1998, 
  1.6             sections 103E.025, subdivision 5; and 103E.615, 
  1.7             subdivision 5. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1998, section 103E.025, 
  1.10  subdivision 5, is amended to read: 
  1.11     Subd. 5.  [MONEY TO PAY ASSESSMENTS.] Assessments for 
  1.12  benefits made against the state land or water area in a 
  1.13  proceeding must be paid out of money appropriated and available 
  1.14  to pay assessments as provided by law in section 103E.615, 
  1.15  subdivision 5.  
  1.16     Sec. 2.  Minnesota Statutes 1998, section 103E.615, 
  1.17  subdivision 5, is amended to read: 
  1.18     Subd. 5.  [STATE PROPERTY.] (a) State property, including 
  1.19  rural credit property, is assessable for benefits received.  The 
  1.20  assessment must be paid by the state from funds appropriated and 
  1.21  available Money to make the payments for drainage assessments 
  1.22  after the state officer having jurisdiction over the assessed 
  1.23  property certifies the assessment is annually appropriated from 
  1.24  the general fund to the commissioner of finance.  By May 1 each 
  1.25  year, county auditors shall certify drainage assessments for 
  1.26  state lands based on benefits received in the previous calendar 
  2.1   year. 
  2.2      (b) In July of each year the commissioner of finance shall 
  2.3   make the payments to counties for all drainage assessments 
  2.4   certified under paragraph (a). 
  2.5      Sec. 3.  [APPROPRIATION.] 
  2.6      (a) $....... is appropriated in fiscal year 2000 from the 
  2.7   general fund to the commissioner of finance for payment of 
  2.8   drainage assessments certified under paragraph (b). 
  2.9      (b) By June 1, 1999, county auditors shall certify the 
  2.10  amount of drainage assessments to state lands for benefits 
  2.11  received prior to January 1, 1999, that have not been previously 
  2.12  paid. 
  2.13     (c) In July of 1999, the commissioner of finance shall make 
  2.14  the payments to counties for all drainage assessments certified 
  2.15  under paragraph (b). 
  2.16     Sec. 4.  [EFFECTIVE DATES.] 
  2.17     Sections 1 and 2 are effective for state assessments based 
  2.18  on benefits received in calendar year 1999, payable in 2000 and 
  2.19  thereafter.  Section 3 is effective the day following final 
  2.20  enactment.
