1.1 A bill for an act 1.2 relating to insurance; requiring equal coverage of 1.3 inherited metabolic diseases; amending Minnesota 1.4 Statutes 1998, section 62A.26. 1.5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 1998, section 62A.26, is 1.7 amended to read: 1.8 62A.26 [COVERAGE FORPHENYLKETONURIA TREATMENTINHERITED 1.9 METABOLIC DISEASES.] 1.10 Subdivision 1. [SCOPE OF COVERAGE.] This section applies 1.11 to all policies of accident and health insurance, health 1.12 maintenance contracts regulated under chapter 62D, health 1.13 benefit certificates offered through a fraternal benefit society 1.14 regulated under chapter 64B, and group subscriber contracts 1.15 offered by nonprofit health service plan corporations regulated 1.16 under chapter 62C, but does not apply to policies designed 1.17 primarily to provide coverage payable on a per diem, fixed 1.18 indemnity or nonexpense incurred basis, or policies that provide 1.19 only accident coverage. 1.20 Subd. 2. [REQUIRED COVERAGE.] Every policy, plan, 1.21 certificate, or contract referred to in subdivision 1 issued or 1.22 renewed after August 1, 1985, must provide coverage for special 1.23 dietary treatment forphenylketonuriainherited metabolic 1.24 diseases when recommended by a physician. For purposes of this 1.25 section, "inherited metabolic diseases" means phenylketonuria, 2.1 hypothyroidism, and galactosemia. 2.2 Sec. 2. [EFFECTIVE DATE.] 2.3 The changes made by section 1 are effective August 1, 1999, 2.4 and apply to coverage issued or renewed on or after that date.
