A bill for an act
relating to construction codes; providing a limited exemption.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin LIMITED EXEMPTION FROM STATE BUILDING CODE;
REDWOOD COUNTY.

new text begin (a) Notwithstanding any law to the contrary, an eligible structure described in
paragraph (b) shall be exempted from compliance with the following automatic sprinkler
system provisions:

new text begin (1) the sprinkler system provision of the 2006 edition of the International Building
Code, section 903.2.1.2, as adopted by the State Building Code; and

new text begin (2) the sprinkler system provision of the 2006 edition of the International Fire Code,
section 903.2.1.2, as adopted by the State Fire Code.

new text begin (b) An eligible structure is one that:
new text end

new text begin (1) is located in Redwood County and is on the property known as the Gilfillan
Estate;
new text end

new text begin (2) is owned by a historical society formed in 1949;
new text end

new text begin (3) is currently less than 2,800 square feet in total area with an occupant load of
fewer than 200 occupants, and, after expansion and renovation, will be less than 7,000
square feet in total area with an occupant load of fewer than 400 occupants;

new text begin (4) has use and occupancy classification codes of "A-2" and "B" under the 2006
edition of the International Building Code, as adopted by the State Building Code; and

new text begin (5) was built in 1998.

new text begin (c) For purposes of certification of plans pursuant to Minnesota Statutes, section
326.03, subdivision 1, and Minnesota Rules, chapters 1800 and 1805, if an architecture
plan of a structure otherwise complies with applicable laws, ordinances, and building
codes relating to design, any plan relating to a structure described in paragraph (b) that
does not include plans for an automatic sprinkler system exempted in paragraph (a) shall be
deemed to comply with applicable laws, ordinances, and building codes relating to design.
