  1.1                          A bill for an act 
  1.2             relating to education; allowing a small school 
  1.3             district located on the border to employ a teacher 
  1.4             licensed in a contiguous state under a short-term 
  1.5             contract; proposing coding for new law in Minnesota 
  1.6             Statutes, chapter 122A.  
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [122A.35] [SHORT-TERM CONTRACTS FOR TEACHERS 
  1.9   LICENSED IN CONTIGUOUS STATES; SMALL BORDER DISTRICTS.] 
  1.10     (a) Notwithstanding other law or rule to the contrary, a 
  1.11  school district with fewer than 400 resident pupils enrolled in 
  1.12  grades seven through 12 located on the border of the state may 
  1.13  employ a qualified teacher to teach who is licensed in a 
  1.14  contiguous state.  Teachers employed under this section are 
  1.15  subject to the licensure requirements of the state issuing their 
  1.16  teaching license and are not subject to Minnesota teacher 
  1.17  licensure requirements.  Such teachers shall have short-term 
  1.18  limited contracts that terminate within one year of the date on 
  1.19  which the contract is executed.  The school board may terminate 
  1.20  the teacher for cause during the term of a contract under this 
  1.21  section; the board must hold a hearing on the discharge at the 
  1.22  teacher's request.  The teacher has no rights to a contract in a 
  1.23  subsequent year under this section. 
  1.24     (b) The provisions of section 122A.40 or 122A.41 shall not 
  1.25  apply to the initial award, renewal, or termination of a 
  1.26  contract under this section.  The provisions of this section 
  2.1   concerning short-term, limited contracts shall not be construed 
  2.2   to alter any aspect of other contracts executed by the school 
  2.3   board. 
  2.4      (c) The school district must provide timely notice to the 
  2.5   board of teaching and the commissioner of any contract executed 
  2.6   under this section. 
  2.7      [EFFECTIVE DATE.] This section is effective for the 
  2.8   2001-2002 school year and following.
