  1.1                          A bill for an act 
  1.2             relating to health; allowing application for 
  1.3             designation of an essential community provider; 
  1.4             amending Minnesota Statutes 2003 Supplement, section 
  1.5             62Q.19, subdivision 2.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2003 Supplement, section 
  1.8   62Q.19, subdivision 2, is amended to read: 
  1.9      Subd. 2.  [APPLICATION.] (a) Any provider may apply to the 
  1.10  commissioner for designation as an essential community provider 
  1.11  by submitting an application form developed by the 
  1.12  commissioner.  Except as provided in paragraphs (d) and (e), 
  1.13  applications must be accepted within two years after the 
  1.14  effective date of the rules adopted by the commissioner to 
  1.15  implement this section. 
  1.16     (b) Each application submitted must be accompanied by an 
  1.17  application fee in an amount determined by the commissioner.  
  1.18  The fee shall be no more than what is needed to cover the 
  1.19  administrative costs of processing the application. 
  1.20     (c) The name, address, contact person, and the date by 
  1.21  which the commissioner's decision is expected to be made shall 
  1.22  be classified as public data under section 13.41.  All other 
  1.23  information contained in the application form shall be 
  1.24  classified as private data under section 13.41 until the 
  1.25  application has been approved, approved as modified, or denied 
  2.1   by the commissioner.  Once the decision has been made, all 
  2.2   information shall be classified as public data unless the 
  2.3   applicant designates and the commissioner determines that the 
  2.4   information contains trade secret information. 
  2.5      (d) The commissioner shall accept an application for 
  2.6   designation as an essential community provider until June 30, 
  2.7   2001 2004, from: 
  2.8      (1) one applicant that is a nonprofit community health care 
  2.9   facility, services agency certified as a medical assistance 
  2.10  provider effective April 1, 1998, that provides culturally 
  2.11  competent health care to an underserved Southeast Asian 
  2.12  immigrant and refugee population residing in the immediate 
  2.13  neighborhood of the facility; 
  2.14     (2) one applicant that is a nonprofit home health care 
  2.15  provider, certified as a Medicare and a medical assistance 
  2.16  provider that provides culturally competent home health care 
  2.17  services to a low-income culturally diverse population; 
  2.18     (3) up to five applicants that are nonprofit community 
  2.19  mental health centers certified as medical assistance providers 
  2.20  that provide mental health services to children with serious 
  2.21  emotional disturbance and their families or to adults with 
  2.22  serious and persistent mental illness; and 
  2.23     (4) one applicant that is a nonprofit provider certified as 
  2.24  a medical assistance provider that provides mental health, child 
  2.25  development, and family services to children with physical and 
  2.26  mental health disorders and their families. 
  2.27     (e) The commissioner shall accept an application for 
  2.28  designation as an essential community provider until June 30, 
  2.29  2003, from one applicant that is a nonprofit community clinic 
  2.30  located in Hennepin County that provides health care to an 
  2.31  underserved American Indian population and that is collaborating 
  2.32  with other neighboring organizations on a community diabetes 
  2.33  project and an immunization project mental health, behavioral 
  2.34  health, chemical dependency, employment, and health wellness 
  2.35  services to the underserved Spanish-speaking Latino families and 
  2.36  individuals with locations in Minneapolis and St. Paul. 
  3.1      Sec. 2.  [EFFECTIVE DATE.] 
  3.2      Section 1 is effective the day following final enactment.
