A bill for an act
relating to county program aid; allowing the commissioner of revenue to
withhold payments if certain reporting requirements are not met; appropriating
money for counties for individual sewage treatment systems grants; amending
Minnesota Statutes 2006, section 477A.014, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 477A.014, is amended by adding a
subdivision to read:

new text begin Withholding of county program aid. new text end

new text begin Notwithstanding any law to the
contrary, the commissioner shall withhold payments of county program aid under section
477A.0124 to any county if requested to do so by the commissioner of the Pollution
Control Agency. The commissioner of the Pollution Control Agency may request the
withholding of these payments if the county has not met the reporting requirements under
Minnesota Rules, part 7080.0310, subpart 5. The commissioner of the Pollution Control
Agency shall inform the commissioner of revenue when the reporting requirements are
met and the commissioner shall then pay any withheld payments to the county.

new text begin This section is effective for aids payable in calendar year
2008 and thereafter.

Sec. 2. new text begin APPROPRIATION.
new text end

new text begin $1,000,000 is appropriated for fiscal year 2008 from the general fund to the
commissioner of the Pollution Control Agency to administer and make grants to counties
to improve individual sewage treatment systems. Funds unexpended and unencumbered
in fiscal year 2008 are available for fiscal year 2009.
