  1.1                          A bill for an act 
  1.2             relating to capital improvements; authorizing spending 
  1.3             to acquire and better public land and buildings and 
  1.4             other public improvements of a capital nature for 
  1.5             higher education with certain conditions; authorizing

  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8   Section 1.  [CAPITAL IMPROVEMENT APPROPRIATIONS.] 
  1.9      The sums in the column under "APPROPRIATIONS" are 
  1.10  appropriated from the bond proceeds fund, or another named fund, 
  1.11  to the state agencies or officials indicated, to be spent for 
  1.12  public purposes.  Appropriations of bond proceeds must be spent 
  1.13  as authorized by the Minnesota Constitution, article XI, section 
  1.14  5, paragraph (a), to acquire and better public land and 
  1.15  buildings and other public improvements of a capital nature, or 
  1.16  as authorized by article XI, section 5, paragraphs (b) to (j), 
  1.17  or article XIV.  Unless otherwise specified, the appropriations 
  1.18  in this act are available until the project is completed or 
  1.19  abandoned.  Appropriations for asset preservation not spent or 
  1.20  encumbered by June 30, 2006, are canceled July 1, 2006.

  3.27  In lieu of debt service, the Board of 
  3.28  Regents shall contribute at least 
  3.29  one-third of the total project costs 
  3.30  for projects authorized by this 
  3.31  section, except for higher education 
  3.32  asset preservation and replacement 
  3.33  under subdivisions 2 and 3. 
  3.34  Subd. 8.  Contingencies                              
  3.35  The commissioner of finance must 
  3.36  combine into one account, under the 
  3.37  control of the Board of Regents, the 
  3.38  portion of each appropriation in this 
  3.39  section that is attributable to the 
  3.40  amount budgeted for contingencies for 
  3.41  projects in this section.  The board 
  3.42  must manage the account to pay for 
  3.43  exceptional but necessary costs of 
  3.44  projects authorized in this section.  
  3.45  Upon substantial completion or 
  3.46  abandonment of all projects authorized 
  3.47  in this section, the board must use any 
  3.48  funds remaining in the contingency 
  3.49  account for HEAPR under Minnesota

  8.53  Subd. 31.  Debt Service
  8.54  (a) The board shall pay the debt 
  8.55  service on one-third of the principal 
  8.56  amount of state bonds sold to finance 
  8.57  projects authorized by this section, 
  8.58  except for higher education asset 
  8.59  preservation and replacement in 
  8.60  subdivision 2, and except that, where a 
  8.61  nonstate match is required, the debt 
  9.1   service is due on a principal amount 
  9.2   equal to one-third of the total project 
  9.3   cost, less the match committed before 
  9.4   the bonds are sold.  After each sale of 
  9.5   general obligation bonds, the 
  9.6   commissioner of finance shall notify 
  9.7   the board of the amounts assessed for 
  9.8   each year for the life of the bonds. 
  9.9   (b) The commissioner shall reduce the 
  9.10  board's assessment each year by 
  9.11  one-third of the net income from 
  9.12  investment of general obligation bond 
  9.13  proceeds in proportion to the amount of 
  9.14  principal and interest otherwise 
  9.15  required to be paid by the board.  The 
  9.16  board shall pay its resulting net 
  9.17  assessment to the commissioner of 
  9.18  finance by December 1 each year.  If 
  9.19  the board fails to make a payment when 
  9.20  due, the commissioner of finance shall 
  9.21  reduce allotments for appropriations 
  9.22  from the general fund otherwise 
  9.23  available to the board and apply the 
  9.24  amount of the reduction to cover the 
  9.25  missed debt service payment.  The 
  9.26  commissioner of finance shall credit 
  9.27  the payments received from the board to 
  9.28  the bond debt service account in the 
  9.29  state bond fund each December 1 before 
  9.30  money is transferred from the general 
  9.31  fund under Minnesota Statutes, section 
  9.32  16A.641, subdivision 10. 
  9.33  Subd. 32.  Contingencies                                        
  9.34  The commissioner of finance must

  9.54  appropriation is from the bond proceeds 
  9.55  fund. 
  9.56  Sec. 5.  BOND SALE AUTHORIZATION 
  9.57  To provide the money appropriated in 
  9.58  this act from the bond proceeds fund, 
  9.59  the commissioner of finance shall sell 
  9.60  and issue bonds of the state in an 
  9.61  amount up to $....... in the manner, 
  9.62  upon the terms, and with the effect 
  9.63  prescribed by Minnesota Statutes, 
  9.64  sections 16A.631 to 16A.675, and by the 
 10.1   Minnesota Constitution, article XI, 
 10.2   sections 4 to 7.
