  1.1                          A bill for an act 
  1.2             relating to the environment; providing for an 
  1.3             exception to the toxics in products prohibition; 
  1.4             amending Minnesota Statutes 1994, section 115A.9651, 
  1.5             subdivision 1. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 115A.9651, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [PROHIBITION.] (a) Except for 
  1.10  transportation safety materials, no person may distribute for 
  1.11  sale or use in this state any ink, dye, pigment, paint, or 
  1.12  fungicide manufactured after September 1, 1994, into which lead, 
  1.13  cadmium, mercury, or hexavalent chromium has been intentionally 
  1.14  introduced. 
  1.15     (b) For the purposes of this subdivision, the following 
  1.16  terms have the meanings given. 
  1.17     (1) "Intentionally introduce" means to deliberately use a 
  1.18  metal listed in paragraph (a) as an element during manufacture 
  1.19  or distribution of an item listed in paragraph (a).  Intentional 
  1.20  introduction does not include the incidental presence of any of 
  1.21  the prohibited elements.  
  1.22     (2) "Transportation safety materials" means structural 
  1.23  adhesive primers, tamper-proof sealants, electrically insulated 
  1.24  rail joint primers, and similar materials that are manufactured, 
  1.25  distributed, used, or sold primarily or solely for their 
  2.1   transportation safety properties. 
  2.2      (c) The concentration of a listed metal in an item listed 
  2.3   in paragraph (a) may not exceed 100 parts per million.
