  1.1                          A bill for an act
  1.2             relating to firearms; permitting certain uses of 
  1.3             machine guns and short-barreled shotguns that are 
  1.4             relics, keepsakes, or collector's items; amending 
  1.5             Minnesota Statutes 1996, section 609.67, subdivisions 
  1.6             3 and 4. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1996, section 609.67, 
  1.9   subdivision 3, is amended to read: 
  1.10     Subd. 3.  [USES PERMITTED.] The following persons may 
  1.11  own or, possess, or use a machine gun or short-barreled shotgun 
  1.12  provided the provisions of subdivision 4 are complied with: 
  1.13     (1) law enforcement officers for use in the course of their 
  1.14  duties; 
  1.15     (2) chief executive officers of correctional facilities and 
  1.16  other personnel thereof authorized by them and persons in charge 
  1.17  of other institutions for the retention of persons convicted or 
  1.18  accused of crime, for use in the course of their duties; 
  1.19     (3) persons possessing machine guns or short-barreled 
  1.20  shotguns which, although designed as weapons, have been 
  1.21  determined by the superintendent of the bureau of criminal 
  1.22  apprehension or the superintendent's delegate by reason of the 
  1.23  date of manufacture, value, design or other characteristics to 
  1.24  be primarily collector's items, relics, museum pieces or objects 
  1.25  of curiosity, ornaments or keepsakes, and are not likely to be 
  1.26  used as weapons, for use in instruction, competition, or target 
  2.1   practice on a firing range approved by the chief of police or 
  2.2   sheriff in whose jurisdiction the range is located; 
  2.3      (4) manufacturers of ammunition who possess and use machine 
  2.4   guns for the sole purpose of testing ammunition manufactured for 
  2.5   sale to federal and state agencies or political subdivisions; 
  2.6   and 
  2.7      (5) dealers and manufacturers who are federally licensed to 
  2.8   buy and sell, or manufacture machine guns or short-barreled 
  2.9   shotguns and who either use the machine guns or short-barreled 
  2.10  shotguns in peace officer training under courses approved by the 
  2.11  board of peace officer standards and training, or are engaged in 
  2.12  the sale of machine guns or short-barreled shotguns to federal 
  2.13  and state agencies or political subdivisions. 
  2.14     Sec. 2.  Minnesota Statutes 1996, section 609.67, 
  2.15  subdivision 4, is amended to read: 
  2.16     Subd. 4.  [REPORT REQUIRED.] (a) A person owning or, 
  2.17  possessing, or using a machine gun or short-barreled shotgun as 
  2.18  authorized by subdivision 3, clause (1), (2), (3), or (4) shall, 
  2.19  within ten days after acquiring such ownership or possession, 
  2.20  file a written report with the bureau of criminal apprehension, 
  2.21  showing the person's name and address; the person's official 
  2.22  title and position, if any; a description of the machine gun or 
  2.23  short-barreled shotgun sufficient to enable identification 
  2.24  thereof; the purpose for which it is owned or possessed; and 
  2.25  such further information as the bureau may reasonably require. 
  2.26     (b) A dealer or manufacturer owning or having a machine gun 
  2.27  or short-barreled shotgun as authorized by subdivision 3, clause 
  2.28  (5) shall, by the tenth day of each month, file a written report 
  2.29  with the bureau of criminal apprehension showing the name and 
  2.30  address of the dealer or manufacturer and the serial number of 
  2.31  each machine gun or short-barreled shotgun acquired or 
  2.32  manufactured during the previous month. 
  2.33     Sec. 3.  [EFFECTIVE DATE.] 
  2.34     Sections 1 and 2 are effective August 1, 1997, and apply to 
  2.35  acts committed on or after that date.
