A bill for an act
relating to health care; establishing a PrEP and nPEP drug assistance program;
proposing coding for new law in Minnesota Statutes, chapter 256.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin The commissioner of human services shall establish
a program to pay the cost-sharing requirements for pre-exposure prophylaxis (PrEP) and
post-exposure prophylaxis (nPEP) medications and for the laboratory visits associated with
these medications that are covered under the individual's health plan. For purposes of this
program, cost-sharing includes deductibles, co-insurance, or co-payments, but does not
include premiums or the cost of noncovered services.

new text begin To be eligible for the program, the individual must
meet the eligibility requirements for the Ryan White HIV/AIDS Program, Part B, with the
exception of meeting the human-immunodeficiency virus (HIV) status requirement.

new text begin The program may require a participant to utilize
a pharmaceutical company patient assistance program if available before utilizing this
program.
