  1.1                          A bill for an act 
  1.2             relating to corrections; providing that private 
  1.3             facilities licensed to provide long-term residential 
  1.4             secure programming are not subject to the 100-bed 
  1.5             statewide maximum; amending Minnesota Statutes 1996, 
  1.6             section 242.32, subdivision 3. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1996, section 242.32, 
  1.9   subdivision 3, is amended to read: 
  1.10     Subd. 3.  [LICENSURE.] (a) The commissioner shall adopt 
  1.11  rules establishing licensing criteria for secure placement 
  1.12  programming for juvenile offenders.  The criteria must ensure 
  1.13  that the programming is distributed throughout the state.  The 
  1.14  commissioner is authorized to license long-term residential 
  1.15  secure programming up to a maximum of 100 beds statewide in 
  1.16  addition to those licensed as of January 1, 1995.  
  1.17     (b) When a private facility is licensed by the commissioner 
  1.18  to provide long-term residential secure programming, the 
  1.19  facility is not subject to the 100-bed statewide maximum 
  1.20  authorization stated in paragraph (a).
