A bill for an act
relating to human services; establishing a task force to review and recommend
improvements to human services background study disqualification statutes;
requiring a report; appropriating money.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin HUMAN SERVICES BACKGROUND STUDY DISQUALIFICATION
REVIEW TASK FORCE.

new text begin (a) The Human Services Background Study Disqualification
Review Task Force shall consist of 14 members, appointed as follows:

new text begin (1) two members representing licensing boards whose licensed providers are subject to
the provisions in Minnesota Statutes, section 245C.03, appointed by the commissioner of
human services;

new text begin (2) the commissioner of human services or designee;
new text end

new text begin (3) the commissioner of health or designee;
new text end

new text begin (4) two members representing county attorneys and law enforcement, appointed by the
commissioner of human services;
new text end

new text begin (5) two members representing licensed service providers who are subject to the provisions
in Minnesota Statutes, section 245C.15, appointed by the commissioner of human services;

new text begin (6) two members of the public, including one who has been subject to disqualification
based on the provisions in Minnesota Statutes, section 245C.15, and one who has been
subject to a set-aside based on the provisions in Minnesota Statutes, section 245C.15,
appointed by the commissioner of human services;

new text begin (7) two members from the house of representatives, including one appointed by the
speaker of the house and one appointed by the minority leader in the house of representatives;
and

new text begin (8) two members from the senate, including one appointed by the senate majority leader
and one appointed by the senate minority leader.

new text begin (b) Appointments to the task force must be made by June 15, 2021.

new text begin Public members of the task force may be compensated as
provided by Minnesota Statutes, section 15.059, subdivision 3.

new text begin The task force shall review the statutes relating to human services
background study disqualifications, including but not limited to Minnesota Statutes, sections
245C.14 and 245C.15, in order to:

new text begin (1) evaluate the existing statutes' effectiveness in achieving their intended purposes,
including by gathering and reviewing available background study disqualification data;

new text begin (2) identify the existing statutes' weaknesses, inefficiencies, unintended consequences,
or other areas for improvement or modernization; and
new text end

new text begin (3) develop legislative proposals that improve, modernize, or otherwise address the
issues identified in clauses (1) and (2).

new text begin Subd. 4. new text end

new text begin Officers; meetings. new text end

new text begin (a) The first meeting of the task force shall be cochaired
by the task force member from the majority party of the house of representatives and the
task force member from the majority party of the senate. The task force shall elect a chair
and vice-chair at the first meeting who shall preside at the remainder of the task force
meetings. The task force may elect other officers as necessary.

new text begin (b) The task force shall meet at least monthly. The commissioner of human services
shall convene the first meeting by July 1, 2021.

new text begin (c) Meetings of the task force are subject to the Minnesota Open Meeting Law under
Minnesota Statutes, chapter 13D.

new text begin The task force shall submit a final written report by February
11, 2022, to the chairs and ranking minority members of the committees in the house of
representatives and the senate with jurisdiction over human services licensing. The report
shall explain the task force's findings and recommendations relating to each of the duties
under subdivision 3, and include any draft legislation necessary to implement the
recommendations.

subdivision 5 or February 16, 2022, whichever is later.

DISQUALIFICATION REVIEW TASK FORCE.

human services for the Human Services Background Study Disqualification Review Task
Force under section 1. This is a onetime appropriation.
