A bill for an act
relating to drainage; requiring financing of certain drainage projects; prohibiting
transfer of drainage system jurisdiction from water management authority;
amending Minnesota Statutes 2020, sections 103E.635, subdivision 1; 103E.812,
subdivision 1.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 103E.635, subdivision 1, is amended to read:

Subdivision 1.

Authority.

After the contract for the construction of a drainage project
is awarded, the board of an affected county new text begin must finance and new text end may issue the bonds of the
county in an amount necessary to pay the cost of establishing and constructing the drainage
project.

Sec. 2.

Minnesota Statutes 2020, section 103E.812, subdivision 1, is amended to read:

Subdivision 1.

Transfer after lien payment period expires.

After the period originally
fixed or subsequently extended to pay the assessment of the drainage lien expires, all or
part of a drainage system may be new text begin permanently new text end transferred from the jurisdiction of the
drainage authority to a water management authority as provided in this section. new text begin Once a
transfer to a water management authority has been made, jurisdiction must not be transferred
back to the county.
