  1.1                          A bill for an act 
  1.2             relating to human services; requiring the commissioner 
  1.3             of human services to submit a waiver amendment to 
  1.4             expand consumer-directed community support services. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [STATEWIDE AVAILABILITY OF CONSUMER-DIRECTED 
  1.7   COMMUNITY SUPPORTS.] 
  1.8      The commissioner of human services shall submit an 
  1.9   amendment to the federal Health Care Financing Administration by 
  1.10  August 1, 2001, for the home and community-based waivers 
  1.11  established under Minnesota Statutes, section 256B.49, for 
  1.12  persons with traumatic brain injuries, persons who would 
  1.13  otherwise be in a nursing facility, and persons who would 
  1.14  otherwise be in a hospital, to make consumer-directed community 
  1.15  support services available in every county of the state by 
  1.16  January 1, 2002.  If any county declines to participate in the 
  1.17  health and safety and quality assurance requirements for this 
  1.18  service, the commissioner shall contract with another county, 
  1.19  group of counties, or a private agency to plan for and 
  1.20  administer consumer-directed community supports in that county 
  1.21  by January 1, 2002.
