  1.1                          A bill for an act 
  1.2             relating to liquor; authorizing the cities of 
  1.3             Minneapolis, St. Paul, Duluth, and Bloomington to 
  1.4             adopt ordinances authorizing on-sales at hotels during 
  1.5             certain hours; exempting certain sales from on-sale 
  1.6             hours restrictions; amending Minnesota Statutes 2000, 
  1.7             section 340A.504, by adding subdivisions. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2000, section 340A.504, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 2a.  [CERTAIN DISPENSING EXEMPT.] Where a hotel 
  1.12  possessing an on-sale intoxicating liquor license places 
  1.13  containers of intoxicating liquor in cabinets in hotel rooms for 
  1.14  the use of guests staying in those hotel rooms, and a charge is 
  1.15  made for withdrawals from those cabinets, the dispensing of 
  1.16  intoxicating liquor from those cabinets does not constitute a 
  1.17  sale for purposes of subdivision 2. 
  1.18     Sec. 2.  Minnesota Statutes 2000, section 340A.504, is 
  1.19  amended by adding a subdivision to read: 
  1.20     Subd. 7.  [EXTENDED HOURS FOR ON-SALE.] Notwithstanding 
  1.21  subdivision 2, the cities of Minneapolis, St. Paul, Duluth, and 
  1.22  Bloomington may enact an ordinance that authorizes the issuance 
  1.23  of on-sale intoxicating liquor licenses that permit a hotel 
  1.24  licensee to make on-sales of intoxicating liquor between the 
  1.25  hours of 1:00 a.m. and 2:00 a.m. Monday through Friday and 
  1.26  between the hours of 1:00 a.m. and 2:30 a.m. on Saturday and 
  2.1   Sunday.  An ordinance may not limit licenses issued under this 
  2.2   paragraph to a particular geographic area of the city.  The city 
  2.3   enacting the ordinance may issue a temporary permit to a hotel 
  2.4   licensee that authorizes the hotel to sell intoxicating liquor 
  2.5   at on-sale between the hours of 1:00 a.m. and 2:00 a.m. Monday 
  2.6   through Friday and 1:00 a.m. and 2:30 a.m. Saturday and Sunday.  
  2.7   Such a temporary permit may only be issued to a hotel for the 
  2.8   period of time between the date of issuance and the date on 
  2.9   which the hotel's license under section 340A.404, subdivision 1, 
  2.10  expires.  No more than one permit under this paragraph may be 
  2.11  issued to any hotel.  A permit under this subdivision may be 
  2.12  revoked or suspended in the same manner as a license under 
  2.13  section 340A.415. 
  2.14     Sec. 3.  [EFFECTIVE DATE.] 
  2.15     Sections 1 and 2 are effective the day following final 
  2.16  enactment.
