  1.1                          A bill for an act 
  1.2             relating to human services; providing emergency energy 
  1.3             assistance for nursing facilities; appropriating money.
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [EMERGENCY ENERGY ASSISTANCE FOR NURSING 
  1.6   FACILITIES.] 
  1.7      Subdivision 1.  [COMMISSIONER.] By February 28, 2001, the 
  1.8   commissioner of human services shall certify the heating fuel 
  1.9   costs for Medicaid-certified nursing facilities for the rate 
  1.10  year ending June 30, 2000.  The commissioner may require 
  1.11  facilities to report on an expedited basis data necessary to 
  1.12  make this certification. 
  1.13     Subd. 2.  [NURSING FACILITY.] By February 28, 2001, each 
  1.14  Medicaid-certified nursing facility shall submit its anticipated 
  1.15  heating fuel costs for the rate year ending June 30, 2001, to 
  1.16  the commissioner. 
  1.17     Subd. 3.  [ENERGY COST.] The commissioner shall calculate 
  1.18  the difference between the anticipated heating fuel costs under 
  1.19  subdivision 2 and the certified heating fuel costs under 
  1.20  subdivision 1. 
  1.21     Subd. 4.  [REIMBURSEMENT.] The commissioner shall reimburse 
  1.22  each Medicaid-certified nursing facility for 97 percent of the 
  1.23  amount calculated under subdivision 3 not to exceed a statewide 
  1.24  medical assistance expenditure total of $31,350,000.  The 
  2.1   reimbursement shall be accomplished by adjusting the operating 
  2.2   cost per diem of facilities reimbursed under Minnesota Statutes, 
  2.3   section 256B.431 or 256B.434, for the rate period from April 1, 
  2.4   2001, to June 30, 2001.  If the appropriation is insufficient, 
  2.5   the commissioner shall proportionately reduce the reimbursement. 
  2.6      Subd. 5.  [PAYMENT ADJUSTMENT.] By January 31, 2002, the 
  2.7   commissioner of human services shall certify the actual heating 
  2.8   fuel costs for Medicaid-certified nursing facilities for the 
  2.9   rate year ending June 30, 2001, and recalculate the 
  2.10  reimbursement amount under subdivision 4 based on actual costs.  
  2.11  The commissioner may require facilities to report data necessary 
  2.12  to make this certification.  The commissioner shall adjust the 
  2.13  operating cost per diem of facilities reimbursed under Minnesota 
  2.14  Statutes, section 256B.431 or 256B.434, for the period from 
  2.15  April 1, 2002, to June 30, 2002, by the amount of the difference 
  2.16  between the estimated calculation and the actual costs. 
  2.17     Sec. 2.  [APPROPRIATION.] 
  2.18     $10,180,000 is appropriated in fiscal year 2001 from the 
  2.19  general fund to the commissioner of human services for emergency 
  2.20  energy assistance under section 1.  This appropriation is 
  2.21  available until June 30, 2002.  Of this amount, the commissioner 
  2.22  of human services may retain up to $30,000 for the 
  2.23  administration of this program.
