A bill for an act
relating to consumer protection; generally prohibiting
the sale of antibacterial soaps; proposing coding for
new law in Minnesota Statutes, chapter 325F.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin [325F.171] CERTAIN ANTIBACTERIAL PRODUCTS.

new text begin Subdivision 1. new text end

new text begin Generally. new text end

new text begin No person shall offer for sale
in Minnesota any product that:

new text begin (1) is represented as having special capabilities to reduce
dangerous or harmful bacteria in the home as compared to
traditional cleaning products, if the product does not actually
have those capabilities; or
new text end

new text begin (2) is intended for use to clean any part of the human body
and contains triclosan or any similarly acting antibacterial
agent.

new text begin Exceptions. new text end

new text begin This section does not prohibit the
sale of products that would otherwise be prohibited under
subdivision 1, clause (2), when:

new text begin (1) the products are sold for use in health care
facilities;
new text end

new text begin (2) the products are sold for use in the homes of
individuals who have compromised immune systems;
new text end

new text begin (3) the products are sold for use by an individual whose
business or occupation requires significant contact with the
public in a manner that presents a risk of transmission of
infection, and who therefore uses antibacterial products or
offers them to patrons; or

new text begin (4) use of the products by the person to whom they are sold
is required for compliance with any requirement of federal,
state, or local law.
