  1.1                          A bill for an act 
  1.2             relating to agriculture; limiting liability for 
  1.3             application of agricultural chemicals; proposing 
  1.4             coding for new law in Minnesota Statutes, chapter 561. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [561.20] [LIABILITY FOR APPLICATION OF 
  1.7   AGRICULTURAL CHEMICALS.] 
  1.8      Subdivision 1.  [DEFINITIONS.] The definitions in chapter 
  1.9   18D apply to this section. 
  1.10     Subd. 2.  [LIABILITY.] (a) Notwithstanding other law 
  1.11  relating to liability for agricultural chemical use, an end user 
  1.12  or landowner is not liable for the cost of active cleanup or 
  1.13  bodily injury associated with or resulting from agricultural 
  1.14  chemicals if the end user or landowner has applied or has had 
  1.15  others apply agricultural chemicals: 
  1.16     (1) in accordance with state law and any applicable 
  1.17  labeling, including precautionary labeling and applicable 
  1.18  preharvest intervals, at the time of application; and 
  1.19     (2) in accordance with orders of the commissioner. 
  1.20     (b) Compliance with paragraph (a) is a complete defense to 
  1.21  liability of the end user or landowner. 
  1.22     (c) This section does not apply to enforcement actions by 
  1.23  the commissioner under chapter 18B, 18C, 18D, or 18E.
