A bill for an act
relating to health; prohibiting the nontherapeutic use of antimicrobial drugs for
food animals; prohibiting the sale of food produced from animals administered
antimicrobial drugs for nontherapeutic uses; proposing coding for new law in
Minnesota Statutes, chapter 35.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

new text begin (a) For purposes of this section, the following terms
have the meanings given them.

new text begin (b) "Antimicrobial agent" means any drug or derivative of a drug that is used in
humans or intended for use in humans to treat or prevent disease or infection, as well as
any substance, whether produced synthetically or naturally, used to kill or inhibit the
growth of bacteria, viruses, fungi, parasites, or other microorganisms.

new text begin (c) "Food-producing animals" has the meaning given in section 156.16, subdivision 5.

new text begin (d) "Nontherapeutic use of an antimicrobial agent" means any use of an antimicrobial
agent for growth promotion, feed efficiency, weight gain, routine disease prevention, or
other routine purpose, in the absence of any clinical sign of disease in a food-producing
animal. Nontherapeutic use of an antimicrobial agent does not mean use of an
antimicrobial agent under the supervision of a licensed veterinarian for the therapeutic
treatment of a sick food-producing animal.

new text begin No person shall sell or offer for sale in this state,
regardless of place of origin, any food or food product derived from food-producing
animals that were subject to nontherapeutic use of an antimicrobial agent.
