A bill for an act
relating to transportation; establishing an optional mental health designation for
driver's licenses and identification cards and for vehicle registration; providing for
data practices; amending Minnesota Statutes 2018, sections 168.0185; 168.346,
by adding a subdivision; 171.07, by adding a subdivision; 171.12, by adding a
subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 168.0185, is amended to read:

168.0185 RECORD OF VEHICLE REGISTRATION; DISCLOSURE.

(a) The commissioner shall keep a record of all registered vehicles according to (1)
registration plate number, (2) name of the registered owner, (3) make of vehicle and the
vehicle's identification number, for a vehicle so identified, or, if none, the vehicle's serial
number until the manufacturer adopts and uses a vehicle identification number.

(b) The commissioner shall furnish to any person applying for a copy of the registration,
a copy as specified in section 168.327.

(c) The commissioner shall also furnish vehicle registration records, without charge, to
chiefs of police, county sheriffs, prosecuting attorneys, and other law enforcement agencies
with the power to arrest.

new text begin (d) At the request of an applicant who is registering a motor vehicle under section 168.017
or 168.018 and who possesses a driver's license or Minnesota identification card bearing a
mental health designation under section 171.07, subdivision 20, the commissioner must
maintain information related to the mental health designation in the vehicle registration
records.

Sec. 2.

Minnesota Statutes 2018, section 168.346, is amended by adding a subdivision to
read:

new text begin Information related to a mental health designation
under section 168.0185, paragraph (d), is private data on individuals as defined in section
13.02, subdivision 12, except that the commissioner must make the information electronically
available to peace officers in conjunction with vehicle registration records.

Sec. 3.

Minnesota Statutes 2018, section 171.07, is amended by adding a subdivision to
read:

new text begin (a) At the request of an eligible applicant and
upon payment of the required fee, the department must issue, renew, or reissue to the
applicant a driver's license or Minnesota identification card bearing a mental health
designation.

new text begin (b) To be eligible for the designation under this subdivision, the applicant must provide
satisfactory evidence from a mental health practitioner or mental health professional, as the
terms are defined in section 245.462, subdivisions 17 and 18, that the applicant has an autism
spectrum disorder diagnosis or is a person with serious and persistent mental illness, as
defined in section 245.462, subdivision 20.

new text begin (c) An individual approved for the mental health designation under this subdivision is
not required to reapply for the designation for subsequent driver's license or Minnesota
identification card renewals.

new text begin (d) The commissioner must consult with the commissioner of human services to design
the mental health designation and specify mental illness classifications within the designation,
if any.

read:

12, except that the commissioner must make information related to the designation
