A bill for an act
relating to human services; requiring the Department of Human Services to allocate
funds for county reimbursement of costs for incorrectly claimed federal funds.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin ALLOCATION OF APPROPRIATION; INSTITUTIONS FOR MENTAL
DISEASE PAYMENTS.

new text begin The commissioner of human services shall allocate $8,812,000, apportioned among the
general fund appropriations in fiscal year 2022 for operations, children and families, health
care, continuing care for older adults, and community supports, for payments to reimburse
counties in Minnesota for the value of the statewide county share of costs for which federal
funds were claimed, but were not eligible for federal funding for substance use disorder
services provided in institutions for mental disease, for claims paid between January 1,
2014, and June 30, 2019. The commissioner of human services shall issue reimbursement
payments to counties in proportion to each county's share relative to the total statewide
county share. Prior to payment to a county, the county must pay in full any unpaid
consolidated chemical dependency treatment fund invoiced county share.
