  1.1                          A bill for an act 
  1.2             relating to the legislature; providing for the 
  1.3             organization of the house of representatives in case 
  1.4             of tie vote for a house officer; amending Minnesota 
  1.5             Statutes 1998, section 3.06, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 3.06, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 3.  [EVENLY DIVIDED HOUSE.] This subdivision applies 
  1.10  to initial organization of the house of representatives in 
  1.11  January of an odd-numbered year, if there is a tie vote for 
  1.12  speaker of the house of representatives or for any other officer 
  1.13  of the house of representatives.  If this occurs, the candidate 
  1.14  is elected who was nominated by the caucus in the house of 
  1.15  representatives that is of the same political party as the 
  1.16  governor.  If the governor is not of the same political party as 
  1.17  either of the tied caucuses, the candidate is elected who was 
  1.18  nominated by the caucus that is of the same political party as 
  1.19  the president of the Minnesota senate.  If the president of the 
  1.20  senate is not of the same political party as either of the tied 
  1.21  caucuses, the candidate is elected who was nominated by the 
  1.22  caucus whose members received the largest number of votes in 
  1.23  being elected to the house of representatives in the most recent 
  1.24  general election. 
  1.25     If a speaker is elected under the procedures of this 
  2.1   subdivision, all appointments to legislative committees, 
  2.2   legislative commissions, and other legislative bodies must be 
  2.3   made proportionally from the caucuses of each political party.  
  2.4   If a statute provides for an odd number of members of the house 
  2.5   of representatives to serve on a legislative commission, the 
  2.6   caucus that will have the extra member must be determined by lot.
