A bill for an act
relating to the environment; directing the Environmental Quality Board to study
and adopt rules relating to environmental review of certain biofuel production
facilities; proposing coding for new law in Minnesota Statutes, chapter 116D.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

PRODUCTION FACILITIES.

new text begin (a) The Environmental Quality Board, in consultation with the commissioner of the
Pollution Control Agency and the commissioner of natural resources, shall study and
adopt rules pursuant to chapter 14 to develop an alternative environmental review process
for biofuel production facilities that produce less than 125,000,000 gallons of biofuel
annually. The alternative process must:

new text begin (1) streamline the requirements for environmental review of the biofuel production
facilities;

new text begin (2) ensure that the complete environmental review process for the biofuel production
facilities will not take longer than 180 days to complete;

new text begin (3) protect the state's environment and natural resources; and

new text begin (4) provide for public comment.

new text begin (b) The board must submit a copy of the proposed rules and a summary of public
comments received on the rules to the members of the senate and house committees and
divisions having jurisdiction over environment and natural resources policy and budget
by December 1, 2007. The rules must not become effective until 60 days after they are
submitted to the committee members and must become effective no later than June 1, 2008.
