  1.1                          A bill for an act
  1.2             relating to taxation; property; allowing county boards 
  1.3             to delegate authority to the county auditor for 
  1.4             tax-forfeited land administration and property tax 
  1.5             abatement; amending Minnesota Statutes 1994, section 
  1.6             375.192, by adding a subdivision; proposing coding for 
  1.7             new law in Minnesota Statutes, chapter 282. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [282.135] [DELEGATION BY COUNTY BOARD.] 
  1.10     Except as provided in section 282.13 and notwithstanding 
  1.11  any other law to the contrary, the county board may delegate to 
  1.12  the county auditor any authority, power, or responsibility 
  1.13  relating generally to the administration of tax-forfeited land 
  1.14  assigned to the county board under chapter 282.  This delegation 
  1.15  includes, but is not limited to, the authority, power, and 
  1.16  responsibility to classify tax-forfeited land as conservation or 
  1.17  nonconservation property; set the appraisal values and terms of 
  1.18  sale and sell at public auction; initiate legal proceedings to 
  1.19  cancel purchase and repurchase contracts in default status; 
  1.20  authorize reinstatement of canceled tax-forfeited contracts; and 
  1.21  authorize former owners and other eligible parties to repurchase 
  1.22  tax-forfeited land.  If delegation is granted under this 
  1.23  section, the county board shall prescribe the conditions for 
  1.24  delegation and may revoke the delegation without good cause or 
  1.25  prior notice.  If the county auditor holds elective office, no 
  1.26  delegation shall be made under this section unless the county 
  2.1   auditor concurs in the delegation. 
  2.2      Sec. 2.  Minnesota Statutes 1994, section 375.192, is 
  2.3   amended by adding a subdivision to read: 
  2.4      Subd. 4.  [DELEGATION BY COUNTY BOARD.] Notwithstanding any 
  2.5   law to the contrary, the county board may delegate to the county 
  2.6   auditor any authority, power, or responsibility assigned to the 
  2.7   county board in this section.  If delegation is granted under 
  2.8   this subdivision, the county board shall prescribe the 
  2.9   conditions for the delegation and may revoke delegation without 
  2.10  good cause or prior notice.  If the county auditor holds 
  2.11  elective office, no delegation shall be made under this 
  2.12  subdivision unless the county auditor concurs in the delegation. 
  2.13     Sec. 3.  [EFFECTIVE DATE.] 
  2.14     Sections 1 and 2 are effective the day following final 
  2.15  enactment.
