  1.1                          A bill for an act 
  1.2             relating to liquor; authorizing the issuance of 
  1.3             intoxicating liquor licenses to the division of parks 
  1.4             and recreation of the city of Saint Paul; amending 
  1.5             Laws 1990, chapter 554, section 19. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Laws 1990, chapter 554, section 19, is amended 
  1.8   to read: 
  1.9      Sec. 19.  [CITY OF ST. PAUL; WINE AND BEER LICENSES.] 
  1.10     Subdivision 1.  [LICENSE AUTHORIZED.] The city of St. Paul 
  1.11  may issue on-sale nonintoxicating malt liquor licenses and, 
  1.12  on-sale wine licenses, and on-sale intoxicating liquor licenses 
  1.13  to the city's division of parks and recreation.  The licenses 
  1.14  authorize the sale or service of wine or, nonintoxicating malt 
  1.15  liquor, or intoxicating liquor on property owned by the city and 
  1.16  under the jurisdiction of the division by: 
  1.17     (1) employees of the city; 
  1.18     (2) persons holding a permit from the division to conduct 
  1.19  an event and sell or serve wine or, nonintoxicating malt liquor, 
  1.20  or intoxicating liquor to persons attending the event; or 
  1.21     (3) persons who have contracted with the city to sell or 
  1.22  serve wine or, nonintoxicating malt liquor, or intoxicating 
  1.23  liquor on such property. 
  1.24     Subd. 2.  [PERMITS; CONTRACTS.] (a) Permits issued by the 
  1.25  city under subdivision 1, clause (2), and contracts entered into 
  2.1   by the city under subdivision 1, clause (3), must provide for: 
  2.2      (1) the duration of the permit or contract; 
  2.3      (2) the premises or area in which sales or service of 
  2.4   wine or, nonintoxicating malt liquor, or intoxicating liquor 
  2.5   will be made; 
  2.6      (3) the persons to whom such sales or service will be made; 
  2.7      (4) the days and hours in which such sales or service will 
  2.8   be made; and 
  2.9      (5) obtaining by the permit holder or contracted vendor of 
  2.10  such liquor liability insurance or bond, or both, as the city 
  2.11  considers necessary to protect the city's interest as the holder 
  2.12  of the license. 
  2.13     (b) A permit may be issued or a contract entered into under 
  2.14  this section with a person who does not hold a license issued 
  2.15  under Minnesota Statutes, chapter 340A, for the retail sale of 
  2.16  alcoholic beverages. 
  2.17     (c) The division may, without notice or hearing, refuse to 
  2.18  issue a permit under subdivision 1, clause (2). 
  2.19     Subd. 3.  [CITY COUNCIL APPROVAL.] The St. Paul city 
  2.20  council must approve each: 
  2.21     (1) facility at which wine or, nonintoxicating malt liquor, 
  2.22  or intoxicating liquor will be sold or served by city employees; 
  2.23     (2) permit issued under subdivision 1, clause (2); and 
  2.24     (3) contract entered into under subdivision 1, clause (3). 
  2.25     Subd. 4.  [APPLICABILITY OF GENERAL LAW.] All provisions of 
  2.26  Minnesota Statutes, chapter 340A, not inconsistent with this 
  2.27  section apply to licenses issued under this section.  Licenses 
  2.28  authorized by this section are in addition to any other licenses 
  2.29  authorized by law. 
  2.30     Sec. 2.  [EFFECTIVE DATE.] 
  2.31     Section 1 is effective upon its approval by a majority of 
  2.32  the governing body of the city of Saint Paul and upon compliance 
  2.33  with Minnesota Statutes, section 645.021.
