A bill for an act
relating to education; providing for a pilot program
for paying the additional cost of school breakfast and
lunch special diets based on religious beliefs of
students; appropriating money.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

A two-year special diet breakfast and lunch pilot program
is established for the 2005-2006 and 2006-2007 school years to
pay the additional cost of school breakfast and lunch that is a
special diet based on a student's religious beliefs. A school
with at least 20 percent of its students in average daily
membership during the 2004-2005 school year receiving full paid,
reduced, and free breakfast, lunch, or both that is a special
diet based on the religious beliefs of the student is eligible
to participate in this program. The state must pay a
participating district the amount necessary to pay any
additional cost for each full paid, reduced, and free student
breakfast and lunch that is a special diet based on the
student's religious beliefs and served to the student in the
district. This section expires July 1, 2007.

If the appropriation amount attributable to either year is
insufficient, the rate of payment for each student special diet
breakfast and lunch shall be reduced and the aid for that year
shall be prorated among participating schools so as not to
exceed the total authorized appropriation for that year. Any
balance in the first year does not cancel but is available in
the second year.
