A bill for an act
relating to state lands; modifying land conveyance to the city of Wayzata;
amending Laws 2008, chapter 368, article 1, section 34.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Laws 2008, chapter 368, article 1, section 34, is amended to read:


Sec. 34. deleted text begin PRIVATE SALEdeleted text end new text begin CONVEYANCEnew text end OF SURPLUS STATE LAND;
HENNEPIN COUNTY.

(a) Notwithstanding Minnesota Statutes, sections 94.09 deleted text begin and 94.10deleted text end new text begin to 94.16new text end , the
commissioner of natural resources deleted text begin may sell by private saledeleted text end new text begin shall conveynew text end to the city of
Wayzata new text begin for no consideration new text end the surplus land that is described in paragraph (c).

(b) The conveyance must be in a form approved by the attorney general. The
attorney general may make necessary changes to the legal description to correct errors and
ensure accuracy. The deleted text begin commissioner may sell to the city of Wayzata, for less than the value
of the land as determined by the commissioner, but the
deleted text end conveyance must provide that the
land described in paragraph (c) be used for the public and reverts to the state if the city of
Wayzata fails to provide for public use or abandons the public use of the land.

(c) The land deleted text begin that may be solddeleted text end new text begin to be conveyednew text end is located in Hennepin County and is
described as: Tract F, Registered Land Survey No. 1168.

(d) The Department of Natural Resources has determined that the state's land
management interests would best be served if the land was conveyed to the city of
Wayzata.
