  1.1                          A bill for an act 
  1.2             relating to retirement; modifying teachers retirement 
  1.3             provisions for labor organization employees; amending 
  1.4             Minnesota Statutes 2000, section 354.41, subdivision 
  1.5             4; repealing Minnesota Statutes 2000, section 354.41, 
  1.6             subdivision 9. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 354.41, 
  1.9   subdivision 4, is amended to read: 
  1.10     Subd. 4.  [MEMBERSHIP ELIGIBILITY FOR LABOR ORGANIZATION 
  1.11  EMPLOYEES.] (a) A person who is a member on an authorized leave 
  1.12  of absence and is employed as an employee of officer by the 
  1.13  Minnesota federation of teachers or its affiliated branches 
  1.14  within the state, the Minnesota education association, the 
  1.15  Minnesota association of school principals, the Minnesota 
  1.16  association of secondary school principals or the Minnesota a 
  1.17  labor organization that is the exclusive bargaining agent 
  1.18  representing teachers or an association of school administrators 
  1.19  may elect to be a coordinated member of the association based on 
  1.20  that employment, subject to the limitations set forth in 
  1.21  subdivisions 4a and 4b.  However, no person is entitled to 
  1.22  membership under this section if the person also is a member of 
  1.23  a teachers retirement association in a city of the first class 
  1.24  organized under chapter 354A for the same period of service.  
  1.25     (b) The election must be made within 90 days of commencing 
  1.26  employment by the labor organization. 
  2.1      Sec. 2.  [REPEALER.] 
  2.2      Minnesota Statutes 2000, section 354.41, subdivision 9, is 
  2.3   repealed. 
  2.4      Sec. 3.  [EFFECTIVE DATE.] 
  2.5      Sections 1 and 2 are effective retroactive to July 1, 1996, 
  2.6   and apply to employment on or after that date.
