  1.1                          A bill for an act 
  1.2             relating to transportation; allowing population of 
  1.3             city to be determined by estimate of metropolitan 
  1.4             council or state demographer for purpose of qualifying 
  1.5             for municipal state-aid street fund apportionment; 
  1.6             amending Minnesota Statutes 1996, section 162.09, 
  1.7             subdivision 4. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1996, section 162.09, 
  1.10  subdivision 4, is amended to read: 
  1.11     Subd. 4.  [FEDERAL CENSUS TO BE CONCLUSIVE.] (a) In 
  1.12  determining whether any city has a population of 5,000 or more, 
  1.13  the last federal census shall be conclusive, except as otherwise 
  1.14  provided in this subdivision.  
  1.15     (b) A city that has previously been classified as having a 
  1.16  population of 5,000 or more for the purposes of chapter 162 and 
  1.17  whose population decreases by less than 15 percent from the 
  1.18  census figure that last qualified the city for inclusion shall 
  1.19  receive the following percentages of its 1981 apportionment for 
  1.20  the years indicated:  1982, 66 percent and 1983, 33 percent.  
  1.21  Thereafter the city shall not receive any apportionment from the 
  1.22  municipal state-aid street fund unless its population is 
  1.23  determined to be 5,000 or over by a federal census.  The 
  1.24  governing body of the city may contract with the United States 
  1.25  Bureau of the Census to take one special census before January 
  1.26  1, 1986.  A certified copy of the results of the census shall be 
  2.1   filed with the appropriate state authorities by the city.  The 
  2.2   result of the census shall be the population of the city for the 
  2.3   purposes of any law providing that population is a required 
  2.4   qualification for distribution of highway aids under chapter 
  2.5   162.  The special census shall remain in effect until the 1990 
  2.6   federal census is completed and filed.  The expense of taking 
  2.7   the special census shall be paid by the city.  
  2.8      (c) If an entire area not heretofore incorporated as a city 
  2.9   is incorporated as such during the interval between federal 
  2.10  censuses, its population shall be determined by its 
  2.11  incorporation census.  The incorporation census shall be 
  2.12  determinative of the population of the city only until the next 
  2.13  federal census. 
  2.14     (d) The population of a city created by the consolidation 
  2.15  of two or more previously incorporated cities shall be 
  2.16  determined by the most recent population estimate of the 
  2.17  metropolitan council or state demographer, until the first 
  2.18  federal decennial census or special census taken after the 
  2.19  consolidation. 
  2.20     (e) The population of a city that is not receiving a 
  2.21  municipal state-aid street fund apportionment shall be 
  2.22  determined, upon request of the city, by the most recent 
  2.23  population estimate of the metropolitan council or state 
  2.24  demographer.  A municipal state-aid street fund apportionment 
  2.25  received by the city must be based on this population estimate 
  2.26  until the next federal decennial census or special census.
