  1.1                          A bill for an act 
  1.2             relating to consumer protection; generally prohibiting 
  1.3             the sale of antibacterial soaps; proposing coding for 
  1.4             new law in Minnesota Statutes, chapter 325F. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [325F.171] [CERTAIN ANTIBACTERIAL PRODUCTS.] 
  1.7      Subdivision 1.  [GENERALLY.] No person shall offer for sale 
  1.8   in Minnesota any product that: 
  1.9      (1) is represented as having special capabilities to reduce 
  1.10  dangerous or harmful bacteria in the home as compared to 
  1.11  traditional cleaning products, if the product does not actually 
  1.12  have those capabilities; or 
  1.13     (2) is intended for use to clean any part of the human body 
  1.14  and contains triclosan or any similarly acting antibacterial 
  1.15  agent. 
  1.16     Subd. 2.  [EXCEPTIONS.] This section does not prohibit the 
  1.17  sale of products that would otherwise be prohibited under 
  1.18  subdivision 1, clause (2), when: 
  1.19     (1) the products are sold for use in health care 
  1.20  facilities; 
  1.21     (2) the products are sold for use in the homes of 
  1.22  individuals who have compromised immune systems; 
  1.23     (3) the products are sold for use by an individual whose 
  1.24  business or occupation requires significant contact with the 
  1.25  public in a manner that presents a risk of transmission of 
  2.1   infection, and who therefore uses antibacterial products or 
  2.2   offers them to patrons; or 
  2.3      (4) use of the products by the person to whom they are sold 
  2.4   is required for compliance with any requirement of federal, 
  2.5   state, or local law.
