A bill for an act
relating to education; allowing public school students to attend courses at nonpublic
schools; amending Minnesota Statutes 2016, section 120A.22, by adding a
subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2016, section 120A.22, is amended by adding a subdivision
to read:

new text begin Attending courses at a nonpublic school. new text end

new text begin (a) A 9th, 10th, 11th, or 12th grade
student enrolled in a public school may attend courses at a nonpublic school as defined in
subdivision 4 at the student's expense for up to one-third of the minimum hours required
under section 120A.41.

new text begin (b) A district or school must grant academic credit to a pupil attending a course at a
nonpublic school for secondary credit pursuant to this subdivision if the pupil successfully
completes the course. If a comparable course is offered by the school or district, the school
board shall grant a comparable number of credits to the pupil. If no comparable course is
offered by the school or district, the school or district must, as soon as possible, notify the
commissioner, who shall determine the number of credits that shall be granted to a pupil
who successfully completes the course.

new text begin (c) The secondary credits granted to a pupil must be counted toward the graduation
requirements and subject area requirements of the school or district. Evidence of successful
completion of each course and secondary credits granted must be included in the pupil's
secondary school record. A pupil shall provide the school with a copy of the pupil's grade
in each course taken for secondary credit under this subdivision.

new text begin (d) Written notice of attendance in a course at a nonpublic school under this subdivision
must be provided to the pupil's school or district no later than two weeks before the first
day of the nonpublic school course.

new text begin (e) A pupil attending a course under this subdivision is ineligible for nonpublic pupil
aid under section 123B.42. A pupil attending a course under this subdivision shall continue
to generate average daily membership for the enrolling public school district.

new text begin (f) Students who enroll in a course pursuant to this subdivision shall lose no rights,
privileges, or access to services from the district.
