  1.1                          A bill for an act 
  1.2             relating to peace officers; clarifying warrant 
  1.3             authority of alcohol and gambling agents; amending 
  1.4             Minnesota Statutes 1998, section 626.11. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1998, section 626.11, is 
  1.7   amended to read: 
  1.8      626.11 [ISSUANCE OF WARRANT.] 
  1.9      If the judge is satisfied of the existence of the grounds 
  1.10  of the application, or that there is probable cause to believe 
  1.11  their existence, the judge must issue a signed search warrant, 
  1.12  naming the judge's judicial office, to a peace officer in the 
  1.13  judge's county or, to an agent of the bureau of criminal 
  1.14  apprehension, or to an agent of the division of alcohol and 
  1.15  gambling enforcement who is a licensed peace officer as defined 
  1.16  in section 626.84, subdivision 1, paragraph (c).  The warrant 
  1.17  shall direct the officer or agent to search the person or place 
  1.18  named for the property or things specified, and to retain the 
  1.19  property or things in the officer's or agent's custody subject 
  1.20  to order of the court issuing the warrant.
