A bill for an act
relating to education; prohibiting four-day week plans for school calendars;
amending Minnesota Statutes 2010, sections 124D.10, subdivision 13; 124D.12;
124D.126, subdivision 2.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2010, section 124D.10, subdivision 13, is amended to
read:


Subd. 13.

Length of school year.

A charter school must provide instruction
each year for at least the number of days required by section 120A.41. It may provide
instruction throughout the year according to sections 124D.12 to 124D.127 or 124D.128.new text begin
A charter school must not implement a four-day week plan, if the charter school did not
use a four-day week plan in the 2010-2011 school year. A charter school that used a
four-day week plan in the 2010-2011 school year must not implement a four-day week
plan in the 2014-2015 school year or later.

Sec. 2.

Minnesota Statutes 2010, section 124D.12, is amended to read:


124D.12 PURPOSE OF FLEXIBLE LEARNING YEAR PROGRAMS.

Sections 124D.12 to 124D.127 authorize districts to evaluate, plannew text begin ,new text end and employ the
use of flexible learning year programs. It is anticipated that the open selection of the type
of flexible learning year operation from a variety of alternatives will allow each district
seeking to utilize this concept to suitably fulfill the educational needs of its pupils. These
alternatives must include, but not be limited to, various 45-15 plans, four-quarter plans,
quinmester plans, extended learning year plans, new text begin and new text end flexible all-year plansdeleted text begin , and four-day
week plans

Sec. 3.

Minnesota Statutes 2010, section 124D.126, subdivision 2, is amended to read:


Subd. 2.

Limitations.

new text begin (a) new text end Sections 124D.12 to 124D.127 may not be construed
to authorize the commissioner to require the establishment of a flexible learning year
program in any district in which the board has not voted to establish, maintain, and
operate such a program.

new text begin (b) The commissioner must not approve four-day week plans under this section.
Approval for four-day week plans initiated before July 1, 2011, expires July 1, 2014.
