A bill for an act
relating to data practices; modifying requirements related to data on employees
of a government contractor or subcontractor; amending Minnesota Statutes 2012,
section 13.43, subdivision 19.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2012, section 13.43, subdivision 19, is amended to read:


Subd. 19.

Employee of contractor or subcontractor.

maintained as a result of a contractual relationship entered on or after August 1, 2012,
between a government entity and a contractor or subcontractor are private: the personal
telephone number, home address, and e-mail address of a current or former employee of
the contractor or subcontractor. new text begin Except as provided in paragraph (c), new text end a government entity
maintaining data under this subdivision must share the data with another government
entity to perform a function authorized by lawdeleted text begin .deleted text end new text begin , and must disclose the datanew text end

purposes.new text begin The government entity maintaining the data must keep a log of requests for
sharing or disclosure under this section, including the name of the individual making the
request, an address or telephone number at which the individual can be contacted, and, if
applicable, the name of any entity or organization on whose behalf the request is made.

new text begin (b) Any government entity that receives data classified under this subdivision must
maintain a data audit trail that includes, at a minimum:

new text begin (1) all actions in which the data are accessed, printed, shared, or disseminated;
new text end

new text begin (2) the name of the individual responsible for that action; and
new text end

new text begin (3) the purpose and statutory authorization for the action.

new text begin Data contained in the audit trail are public, to the extent that the data are not otherwise
classified by this subdivision.

new text begin (c) A government entity maintaining data classified under this subdivision is not
required to disclose the data if it determines that the requesting government entity or
person intends to use the data, or has used previously requested data, for a purpose not
authorized by paragraph (a).
