  1.1                          A bill for an act 
  1.2             relating to the metropolitan council; modifying the 
  1.3             cost allocation system for the metropolitan disposal 
  1.4             system; amending Minnesota Statutes 1998, section 
  1.5             473.517, subdivision 3. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 473.517, 
  1.8   subdivision 3, is amended to read: 
  1.9      Subd. 3.  [ALLOCATION OF TREATMENT, INTERCEPTOR COSTS; 
  1.10  RESERVED CAPACITY GROWTH PORTION OF CAPITAL COSTS.] For the 
  1.11  purposes of this subdivision, the growth cost portion of an 
  1.12  interceptor or treatment works facility is that portion of the 
  1.13  capital costs for acquisition, construction, or rehabilitation 
  1.14  of the facility which is attributable to the providing of 
  1.15  additional capacity, for either higher volume or higher strength 
  1.16  of flow, for the facility.  In preparing each budget the council 
  1.17  shall estimate determine the growth cost portion of the current 
  1.18  costs of acquisition, betterment construction, rehabilitation, 
  1.19  and debt service, only, of all the treatment works and 
  1.20  interceptors in the metropolitan disposal system which will not 
  1.21  be used to total capacity during the budget year, and the 
  1.22  percentage of such capacity which will not be used, and shall 
  1.23  deduct the same percentage of such treatment works such costs 
  1.24  from the current costs allocated under subdivision 1.  The 
  1.25  council shall also estimate the current costs of acquisition, 
  2.1   betterment, and debt service, only, of the interceptors in the 
  2.2   metropolitan disposal system that will not be used to total 
  2.3   capacity during the budget year, shall estimate the percentage 
  2.4   of the total capacity that will not be used, and shall deduct 
  2.5   the same percentage of interceptor costs from the current costs 
  2.6   allocated under subdivision 1.  The total amount so deducted 
  2.7   with respect to all treatment works and interceptors in the 
  2.8   system shall be allocated among and paid by the respective local 
  2.9   government units in the metropolitan area for which system 
  2.10  capacity unused each year is reserved for future use, in 
  2.11  proportion to the amounts of such capacity reserved for each of 
  2.12  them. through a fee structure to be charged by the council for 
  2.13  new connections to the metropolitan disposal system, in such 
  2.14  amounts and in such manner as established by the council.  The 
  2.15  fee structure may provide for recovery of the council's 
  2.16  administrative costs of the program and for adjustments in the 
  2.17  fee structure which further any adopted goals or strategies of 
  2.18  the council related to land use or growth management.  
  2.19     Sec. 2.  [TRANSITION PLAN.] 
  2.20     The council may adopt an implementation plan for transition 
  2.21  from the reserve capacity system in effect before the effective 
  2.22  date of section 1 and the growth cost system established by that 
  2.23  section.  The transition plan may include, without limitation, a 
  2.24  phase-in of any difference in charges, to be paid by local 
  2.25  government units, between the reserve capacity system and the 
  2.26  new growth cost system.  The council may use any funds collected 
  2.27  under the reserve capacity system for the purposes of the 
  2.28  transition plan and in order to pay the growth cost portion of 
  2.29  current capital costs after December 31, 1999. 
  2.30     Sec. 3.  [CONSTRUCTION.] 
  2.31     Minnesota Statutes, section 645.35, does not apply to 
  2.32  section 1. 
  2.33     Sec. 4.  [APPLICATION.] 
  2.34     This act applies in the counties of Anoka, Carver, Dakota, 
  2.35  Hennepin, Ramsey, Scott, and Washington.  
  2.36     Sec. 5.  [EFFECTIVE DATE.] 
  3.1      Sections 1 to 3 are effective January 1, 2000, for 
  3.2   allocation of the growth cost portion of current capital costs 
  3.3   on and after that date.
