A bill for an act
relating to public safety; eliminating the requirement that a previous conviction
be against a family or household member to enhance a domestic assault
conviction; amending Minnesota Statutes 2008, section 609.2242, subdivision 2.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 609.2242, subdivision 2, is amended to
read:


Subd. 2.

Gross misdemeanor.

Whoever violates subdivision 1 within ten years
of a previous qualified domestic violence-related offense conviction or adjudication
of delinquency deleted text begin against a family or household member as defined in section 518B.01,
subdivision 2

not more than one year or to payment of a fine of not more than $3,000, or both.
