  1.1                          A bill for an act 
  1.2             relating to natural resources; increasing certain 
  1.3             issuance and filing fees for the registration and 
  1.4             licensure of certain recreational vehicles and 
  1.5             watercraft; amending Minnesota Statutes 2002, sections 
  1.6             84.788, subdivision 3; 84.798, subdivision 3; 84.82, 
  1.7             subdivision 2; 84.8713, subdivisions 3, 4; 84.922, 
  1.8             subdivision 2; 86B.415, subdivision 8; 86B.870, 
  1.9             subdivision 1. 
  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11     Section 1.  Minnesota Statutes 2002, section 84.788, 
  1.12  subdivision 3, is amended to read: 
  1.13     Subd. 3.  [APPLICATION; ISSUANCE; REPORTS.] (a) Application 
  1.14  for registration or continued registration must be made to the 
  1.15  commissioner or an authorized deputy registrar of motor vehicles 
  1.16  in a form prescribed by the commissioner.  The form must state 
  1.17  the name and address of every owner of the off-highway 
  1.18  motorcycle. 
  1.19     (b) A person who purchases from a retail dealer an 
  1.20  off-highway motorcycle that is intended to be operated on public 
  1.21  lands or waters shall make application for registration to the 
  1.22  dealer at the point of sale.  The dealer shall issue a temporary 
  1.23  ten-day registration permit to each purchaser who applies to the 
  1.24  dealer for registration.  The dealer shall submit the completed 
  1.25  registration applications and fees to the deputy registrar at 
  1.26  least once each week.  No fee may be charged by a dealer to a 
  1.27  purchaser for providing the temporary permit. 
  2.1      (c) Upon receipt of the application and the appropriate 
  2.2   fee, the commissioner or deputy registrar shall issue to the 
  2.3   applicant, or provide to the dealer, a 60-day temporary receipt 
  2.4   and shall assign a registration number that must be affixed to 
  2.5   the motorcycle in a manner prescribed by the commissioner.  A 
  2.6   dealer subject to paragraph (b) shall provide the registration 
  2.7   materials and temporary receipt to the purchaser within the 
  2.8   ten-day temporary permit period. 
  2.9      (d) The commissioner shall develop a registration system to 
  2.10  register vehicles under this section.  A deputy registrar of 
  2.11  motor vehicles acting under section 168.33, is also a deputy 
  2.12  registrar of off-highway motorcycles.  The commissioner of 
  2.13  natural resources in agreement with the commissioner of public 
  2.14  safety may prescribe the accounting and procedural requirements 
  2.15  necessary to ensure efficient handling of registrations and 
  2.16  registration fees.  Deputy registrars shall strictly comply with 
  2.17  the accounting and procedural requirements.  
  2.18     (e) A fee of $2 In addition to other fees prescribed by 
  2.19  law, a filing fee of $4.50 is charged for each registration 
  2.20  renewal, duplicate or replacement registration card, and 
  2.21  replacement decal and a filing fee of $7 is charged for 
  2.22  each off-highway motorcycle registered registration and 
  2.23  registration transfer issued by: 
  2.24     (1) a deputy registrar and must be deposited in the 
  2.25  treasury of the jurisdiction where the deputy is appointed, or 
  2.26  kept if the deputy is not a public official; or 
  2.27     (2) the commissioner and must be deposited in the state 
  2.28  treasury and credited to the off-highway motorcycle account. 
  2.29     Sec. 2.  Minnesota Statutes 2002, section 84.798, 
  2.30  subdivision 3, is amended to read: 
  2.31     Subd. 3.  [APPLICATION; ISSUANCE.] (a) Application for

  2.33  commissioner, or an authorized deputy registrar of motor 
  2.34  vehicles in a form prescribed by the commissioner.  The form 
  2.35  must state the name and address of every owner of the off-road

  3.1   fee, the commissioner shall register the off-road vehicle and 
  3.2   assign a registration number that must be affixed to the vehicle 
  3.3   in accordance with subdivision 4.  
  3.4      (b) A deputy registrar of motor vehicles acting under 
  3.5   section 168.33 is also a deputy registrar of off-road vehicles.  
  3.6   The commissioner of natural resources in cooperation with the 
  3.7   commissioner of public safety may prescribe the accounting and 
  3.8   procedural requirements necessary to ensure efficient handling 
  3.9   of registrations and registration fees.  Deputy registrars shall 
  3.10  strictly comply with the accounting and procedural 
  3.11  requirements.  A fee of $2 In addition to other fees prescribed 
  3.12  by law must be, a filing fee of $4.50 is charged for each 
  3.13  registration renewal, duplicate or replacement registration 
  3.14  card, and replacement decal and a filing fee of $7 is charged 
  3.15  for each off-road vehicle registered registration and 
  3.16  registration transfer issued by: 
  3.17     (1) a deputy registrar and must be deposited in the 
  3.18  treasury of the jurisdiction where the deputy is appointed, or 
  3.19  retained if the deputy is not a public official; or 
  3.20     (2) the commissioner and must be deposited in the state 
  3.21  treasury and credited to the off-road vehicle account. 
  3.22     Sec. 3.  Minnesota Statutes 2002, section 84.82, 
  3.23  subdivision 2, is amended to read: 
  3.24     Subd. 2.  [APPLICATION, ISSUANCE, REPORTS, ADDITIONAL FEE.] 
  3.25  (a) Application for registration or reregistration shall be made 
  3.26  to the commissioner of natural resources, or the commissioner of 
  3.27  public safety or an authorized deputy registrar of motor 
  3.28  vehicles in such form as the commissioner of public safety shall 
  3.29  prescribe, and shall state the legal name and address of every 
  3.30  owner of the snowmobile.  
  3.31     (b) A person who purchases a snowmobile from a retail 
  3.32  dealer shall make application for registration to the dealer at 
  3.33  the point of sale.  The dealer shall issue a temporary 
  3.34  registration permit to each purchaser who applies to the dealer 
  3.35  for registration.  The temporary registration is valid for 60 
  3.36  days from the date of issue.  Each retail dealer shall submit 
  4.1   completed registration and fees to the deputy registrar at least 
  4.2   once a week.  Upon receipt of the application and the 
  4.3   appropriate fee as hereinafter provided, such snowmobile shall 
  4.4   be registered and a registration number assigned which shall be 
  4.5   affixed to the snowmobile in a clearly visible and permanent 
  4.6   manner for enforcement purposes as the commissioner of natural 
  4.7   resources shall prescribe.  The registration is not valid unless 
  4.8   signed by at least one owner. 
  4.9      (c) Each deputy registrar of motor vehicles acting pursuant 
  4.10  to section 168.33, shall also be a deputy registrar of 
  4.11  snowmobiles.  The commissioner of natural resources in agreement 
  4.12  with the commissioner of public safety may prescribe the 
  4.13  accounting and procedural requirements necessary to assure 
  4.14  efficient handling of registrations and registration fees.  
  4.15  Deputy registrars shall strictly comply with these accounting 
  4.16  and procedural requirements.  
  4.17     (d) A fee of $2 In addition to that otherwise other fees 
  4.18  prescribed by law shall be, a filing fee of $4.50 is charged for 
  4.19  each registration renewal, duplicate or replacement card, and 
  4.20  replacement decal and a filing fee of $7 is charged for each 
  4.21  registration and registration transfer issued by: 
  4.22     (1) each snowmobile registered by the registrar or a deputy 
  4.23  registrar and the additional fee shall be disposed of in the 
  4.24  manner provided in section 168.33, subdivision 2; or 
  4.25     (2) each snowmobile registered by the commissioner and the 
  4.26  additional fee shall be deposited in the state treasury and 
  4.27  credited to the snowmobile trails and enforcement account in the 
  4.28  natural resources fund.  
  4.29     Sec. 4.  Minnesota Statutes 2002, section 84.8713, 
  4.30  subdivision 3, is amended to read: 
  4.31     Subd. 3.  [LICENSE AGENTS.] The commissioner shall sell 
  4.32  metal traction device stickers for a $1 $2 issuance fee through 
  4.33  the process established under section 84.82, subdivision 2. 
  4.34     Sec. 5.  Minnesota Statutes 2002, section 84.8713, 
  4.35  subdivision 4, is amended to read: 
  4.36     Subd. 4.  [DUPLICATE METAL TRACTION DEVICE STICKERS.] The 
  5.1   commissioner or an authorized deputy registrar of motor vehicles 
  5.2   shall issue a duplicate metal traction device sticker to a 
  5.3   person whose sticker is lost or destroyed.  A duplicate sticker 
  5.4   may not be issued unless the applicant takes an oath covering 
  5.5   the facts of loss or destruction of the sticker and signs an 
  5.6   affidavit.  The fee for a duplicate metal traction device 
  5.7   sticker is $2, with an issuing fee of 50 cents $2. 
  5.8      Sec. 6.  Minnesota Statutes 2002, section 84.922, 
  5.9   subdivision 2, is amended to read: 
  5.10     Subd. 2.  [APPLICATION, ISSUANCE, REPORTS.] (a) Application 
  5.11  for registration or continued registration shall be made to the 
  5.12  commissioner of natural resources, the commissioner of public 
  5.13  safety or an authorized deputy registrar of motor vehicles in a 
  5.14  form prescribed by the commissioner.  The form must state the 
  5.15  name and address of every owner of the vehicle.  
  5.16     (b) A person who purchases an all-terrain vehicle from a 
  5.17  retail dealer shall make application for registration to the 
  5.18  dealer at the point of sale.  The dealer shall issue a temporary 
  5.19  ten-day registration permit to each purchaser who applies to the 
  5.20  dealer for registration.  The dealer shall submit the completed 
  5.21  registration application and fees to the deputy registrar at 
  5.22  least once each week.  No fee may be charged by a dealer to a 
  5.23  purchaser for providing the temporary permit. 
  5.24     (c) Upon receipt of the application and the appropriate 
  5.25  fee, the commissioner or deputy registrar shall issue to the 
  5.26  applicant, or provide to the dealer, a 60-day temporary receipt 
  5.27  and shall assign a registration number that must be affixed to 
  5.28  the vehicle in a manner prescribed by the commissioner.  A 
  5.29  dealer subject to paragraph (b) shall provide the registration 
  5.30  materials and temporary receipt to the purchaser within the 
  5.31  ten-day temporary permit period.  The commissioner shall use the 
  5.32  snowmobile registration system to register vehicles under this 
  5.33  section.  
  5.34     (d) Each deputy registrar of motor vehicles acting under 
  5.35  section 168.33, is also a deputy registrar of all-terrain 
  5.36  vehicles.  The commissioner of natural resources in agreement 
  6.1   with the commissioner of public safety may prescribe the 
  6.2   accounting and procedural requirements necessary to assure 
  6.3   efficient handling of registrations and registration fees. 
  6.4   Deputy registrars shall strictly comply with the accounting and 
  6.5   procedural requirements.  
  6.6      (e) A fee of $2 In addition to other fees prescribed by law 
  6.7   shall be, a filing fee of $4.50 is charged for each registration 
  6.8   renewal, duplicate or replacement registration card, and 
  6.9   replacement decal and a filing fee of $7 is charged for each 
  6.10  vehicle registered registration and registration transfer issued 
  6.11  by: 
  6.12     (1) a deputy registrar and shall be deposited in the 
  6.13  treasury of the jurisdiction where the deputy is appointed, or 
  6.14  retained if the deputy is not a public official; or 
  6.15     (2) the commissioner and shall be deposited to the state 
  6.16  treasury and credited to the all-terrain vehicle account in the 
  6.17  natural resources fund. 
  6.18     Sec. 7.  Minnesota Statutes 2002, section 86B.415, 
  6.19  subdivision 8, is amended to read: 
  6.20     Subd. 8.  [REGISTRAR'S FEE.] In addition to the license fee 
  6.21  other fees prescribed by law, a filing fee of $2 $4.50 shall be 
  6.22  charged for a each watercraft license renewal, duplicate or 
  6.23  replacement license, and replacement decal and a filing fee of 
  6.24  $7 shall be charged for each license and license transfer issued 
  6.25  by: 
  6.26     (1) issued through the registrar or a deputy registrar of 
  6.27  motor vehicles and the additional fee shall be disposed of in 
  6.28  the manner provided in section 168.33, subdivision 2; or 
  6.29     (2) issued through the commissioner and the additional fee 
  6.30  shall be deposited in the state treasury and credited to the 
  6.31  water recreation account. 
  6.32     Sec. 8.  Minnesota Statutes 2002, section 86B.870, 
  6.33  subdivision 1, is amended to read: 
  6.34     Subdivision 1.  [FEES.] (a) The fee to be paid to the 
  6.35  commissioner: 
  6.36     (1) for issuing an original certificate of title, including 
  7.1   the concurrent notation of an assignment of the security 
  7.2   interest and its subsequent release or satisfaction, is $15; 
  7.3      (2) for each security interest when first noted upon a 
  7.4   certificate of title, including the concurrent notation of an 
  7.5   assignment of the security interest and its subsequent release 
  7.6   or satisfaction, is $10; 
  7.7      (3) for transferring the interest of an owner and issuing a 
  7.8   new certificate of title, is $10; 
  7.9      (4) for each assignment of a security interest when first 
  7.10  noted on a certificate of title, unless noted concurrently with 
  7.11  the security interest, is $1; and 
  7.12     (5) for issuing a duplicate certificate of title, is $4. 
  7.13     (b) In addition to other statutory fees and taxes, a filing 
  7.14  fee of $3.50 $7 is imposed on every application.  The filing fee 
  7.15  must be shown as a separate item on title renewal notices sent 
  7.16  by the commissioner.
