  1.1                          A bill for an act 
  1.2             relating to traffic regulations; regulating vehicle 
  1.3             weight inspections; amending Minnesota Statutes 1998, 
  1.4             section 169.85, subdivisions 1 and 3. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1998, section 169.85, 
  1.7   subdivision 1, is amended to read: 
  1.8      Subdivision 1.  [DRIVER TO STOP FOR WEIGHING.] The driver 
  1.9   of a vehicle which has been lawfully stopped may be required by 
  1.10  an officer to submit the vehicle and load to a weighing by means 
  1.11  of portable or stationary scales, and the officer may require 
  1.12  that the vehicle be driven to the nearest available scales if 
  1.13  the distance to the scales is no further than five miles, or if 
  1.14  the distance from the point where the vehicle is stopped to the 
  1.15  vehicle's destination is not increased by more than ten miles as 
  1.16  a result of proceeding to the nearest available 
  1.17  scales.  Official traffic control devices as authorized by 
  1.18  section 169.06 may be used to direct the driver to the nearest 
  1.19  scale.  When a truck vehicle weight enforcement or safety 
  1.20  inspection operation is being conducted by means of portable or 
  1.21  stationary scales and signs giving notice of the operation are 
  1.22  posted within the highway right-of-way and adjacent to the 
  1.23  roadway within two miles of the operation, the driver of a truck 
  1.24  or combination of vehicles vehicle registered for or weighing in 
  1.25  excess of 12,000 10,000 pounds, when directed to do so by an 
  2.1   officer or by official traffic control devices as authorized by 
  2.2   section 169.06, shall proceed to the scale or inspection site 
  2.3   and submit the vehicle to weighing and inspection. 
  2.4      Sec. 2.  Minnesota Statutes 1998, section 169.85, 
  2.5   subdivision 3, is amended to read: 
  2.6      Subd. 3.  [MISDEMEANOR.] A driver of a vehicle who (1) 
  2.7   fails or refuses to stop and submit the vehicle and load to a 
  2.8   weighing and a safety inspection as required in this section, (2)
  2.9   fails or refuses, when directed by an officer upon a weighing of 
  2.10  the vehicle, to stop the vehicle and otherwise comply with the 
  2.11  provisions of this section, or (3) fails to comply with an 
  2.12  official traffic control device as authorized by section 169.06 
  2.13  that directs the driver to the nearest scale or inspection site 
  2.14  is guilty of a misdemeanor.
