  1.1                          A bill for an act 
  1.2             relating to recreational vehicles; increasing fees 
  1.3             that may be retained by commissioner of natural 
  1.4             resources, registrar, or deputy registrar for 
  1.5             processing registration of recreational vehicles and 
  1.6             watercraft and licensing of watercraft; amending 
  1.7             Minnesota Statutes 1994, sections 84.788, subdivision 
  1.8             3; 84.798, subdivision 3; 84.82, subdivision 2; 
  1.9             84.922, subdivision 2; 86B.415, subdivision 8; and 
  1.10            86B.870, subdivision 1. 
  1.11  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.12     Section 1.  Minnesota Statutes 1994, section 84.788, 
  1.13  subdivision 3, is amended to read: 
  1.14     Subd. 3.  [APPLICATION; ISSUANCE; REPORTS.] Application for 
  1.15  registration or continued registration must be made to the 
  1.16  commissioner or an authorized deputy registrar of motor vehicles 
  1.17  on a form prescribed by the commissioner.  The form must state 
  1.18  the name and address of every owner of the off-highway 
  1.19  motorcycle and must be signed by at least one owner.  Upon 
  1.20  receipt of the application and the appropriate fee, the 
  1.21  commissioner shall assign a registration number that must be 
  1.22  affixed to the motorcycle in a manner prescribed by the 
  1.23  commissioner.  The commissioner shall develop a registration 
  1.24  system to register vehicles under this section.  A deputy 
  1.25  registrar of motor vehicles acting under section 168.33, is also 
  1.26  a deputy registrar of off-highway motorcycles.  The commissioner 
  1.27  of natural resources in agreement with the commissioner of 
  1.28  public safety may prescribe the accounting and procedural 
  2.1   requirements necessary to ensure efficient handling of 
  2.2   registrations and registration fees.  Deputy registrars shall 
  2.3   strictly comply with the accounting and procedural 
  2.4   requirements.  A fee of 50 cents $2 in addition to other fees 
  2.5   prescribed by law is charged for each off-highway motorcycle 
  2.6   registered by: 
  2.7      (1) a deputy registrar and must be deposited in the 
  2.8   treasury of the jurisdiction where the deputy is appointed, or 
  2.9   kept if the deputy is not a public official; or 
  2.10     (2) the commissioner and must be deposited in the state 
  2.11  treasury and credited to the off-highway motorcycle account. 
  2.12     Sec. 2.  Minnesota Statutes 1994, section 84.798, 
  2.13  subdivision 3, is amended to read: 
  2.14     Subd. 3.  [APPLICATION; ISSUANCE.] Application for 
  2.15  registration or continued registration must be made to the 
  2.16  commissioner, or an authorized deputy registrar of motor 
  2.17  vehicles on a form prescribed by the commissioner.  The form 
  2.18  must state the name and address of every owner of the off-road 
  2.19  vehicle and must be signed by at least one owner.  Upon receipt 
  2.20  of the application and the appropriate fee, the commissioner 
  2.21  shall register the off-road vehicle and assign a registration 
  2.22  number that must be affixed to the vehicle in accordance with 
  2.23  subdivision 4.  A deputy registrar of motor vehicles acting 
  2.24  under section 168.33 is also a deputy registrar of off-road 
  2.25  vehicles.  The commissioner of natural resources in cooperation 
  2.26  with the commissioner of public safety may prescribe the 
  2.27  accounting and procedural requirements necessary to ensure 
  2.28  efficient handling of registrations and registration fees.  
  2.29  Deputy registrars shall strictly comply with the accounting and 
  2.30  procedural requirements.  A fee of 50 cents $2 in addition to 
  2.31  other fees prescribed by law must be charged for each off-road 
  2.32  vehicle registered by: 
  2.33     (1) a deputy registrar, and must be deposited in the 
  2.34  treasury of the jurisdiction where the deputy is appointed, or 
  2.35  retained if the deputy is not a public official; or 
  2.36     (2) the commissioner and must be deposited in the state 
  3.1   treasury and credited to the off-road vehicle account. 
  3.2      Sec. 3.  Minnesota Statutes 1994, section 84.82, 
  3.3   subdivision 2, is amended to read: 
  3.4      Subd. 2.  [APPLICATION, ISSUANCE, REPORTS, ADDITIONAL 
  3.5   FEE.] (a) Application for registration or reregistration shall 
  3.6   be made to the commissioner of natural resources, or the 
  3.7   commissioner of public safety or an authorized deputy registrar 
  3.8   of motor vehicles in such form as the commissioner of public 
  3.9   safety shall prescribe, and shall state the name and address of 
  3.10  every owner of the snowmobile and be signed by at least one 
  3.11  owner.  
  3.12     (b) A person who purchases a snowmobile from a retail 
  3.13  dealer shall make application for registration to the dealer at 
  3.14  the point of sale.  The dealer shall issue a temporary 
  3.15  registration permit to each purchaser who applies to the dealer 
  3.16  for registration.  The temporary registration is valid for 60 
  3.17  days from the date of issue.  Each retail dealer shall submit 
  3.18  completed registration and fees to the deputy registrar at least 
  3.19  once a week.  Upon receipt of the application and the 
  3.20  appropriate fee as hereinafter provided, such snowmobile shall 
  3.21  be registered and a registration number assigned which shall be 
  3.22  affixed to the snowmobile in such manner as the commissioner of 
  3.23  natural resources shall prescribe. 
  3.24     (c) Each deputy registrar of motor vehicles acting pursuant 
  3.25  to section 168.33, shall also be a deputy registrar of 
  3.26  snowmobiles.  The commissioner of natural resources in agreement 
  3.27  with the commissioner of public safety may prescribe the 
  3.28  accounting and procedural requirements necessary to assure 
  3.29  efficient handling of registrations and registration fees.  
  3.30  Deputy registrars shall strictly comply with these accounting 
  3.31  and procedural requirements.  
  3.32     (d) A fee of 50 cents $2 in addition to that otherwise 
  3.33  prescribed by law shall be charged for: 
  3.34     (1) each snowmobile registered by the registrar or a deputy 
  3.35  registrar. and the additional fee shall be disposed of in the 
  3.36  manner provided in section 168.33, subdivision 2; or 
  4.1      (2) each snowmobile registered by the commissioner and the 
  4.2   additional fee shall be deposited in the state treasury and 
  4.3   credited to the snowmobile trails and enforcement account in the 
  4.4   natural resources fund.  
  4.5      Sec. 4.  Minnesota Statutes 1994, section 84.922, 
  4.6   subdivision 2, is amended to read: 
  4.7      Subd. 2.  [APPLICATION, ISSUANCE, REPORTS.] (a) Application 
  4.8   for registration or continued registration shall be made to the 
  4.9   commissioner of natural resources, the commissioner of public 
  4.10  safety or an authorized deputy registrar of motor vehicles on a 
  4.11  form prescribed by the commissioner.  The form must state the 
  4.12  name and address of every owner of the vehicle and be signed by 
  4.13  at least one owner. 
  4.14     (b) Upon receipt of the application and the appropriate fee 
  4.15  the commissioner shall register the vehicle and assign a 
  4.16  registration number that must be affixed to the vehicle in a 
  4.17  manner prescribed by the commissioner.  The commissioner shall 
  4.18  use the snowmobile registration system to register vehicles 
  4.19  under this section.  
  4.20     (c) Each deputy registrar of motor vehicles acting under 
  4.21  section 168.33, is also a deputy registrar of all-terrain 
  4.22  vehicles.  The commissioner of natural resources in agreement 
  4.23  with the commissioner of public safety may prescribe the 
  4.24  accounting and procedural requirements necessary to assure 
  4.25  efficient handling of registrations and registration fees. 
  4.26  Deputy registrars shall strictly comply with the accounting and 
  4.27  procedural requirements.  
  4.28     (d) A fee of 50 cents $2 in addition to other fees 
  4.29  prescribed by law shall be charged for each vehicle registered 
  4.30  by: 
  4.31     (1) a deputy registrar, and shall be deposited in the 
  4.32  treasury of the jurisdiction where the deputy is appointed, or 
  4.33  retained if the deputy is not a public official; or 
  4.34     (2) the commissioner, and shall be deposited to the state 
  4.35  treasury and credited to the all-terrain vehicle account in the 
  4.36  natural resources fund.  
  5.1      Sec. 5.  Minnesota Statutes 1994, section 86B.415, 
  5.2   subdivision 8, is amended to read: 
  5.3      Subd. 8.  [REGISTRAR'S FEE.] (a) In addition to the license 
  5.4   fee, a fee of 50 cents $2 shall be charged for a watercraft 
  5.5   license: 
  5.6      (1) issued through the registrar or a deputy registrar of 
  5.7   motor vehicles.  
  5.8      (b) and the additional fee shall be disposed of in the 
  5.9   manner provided in section 168.33, subdivision 2; or 
  5.10     (2) issued through the commissioner and the additional fee 
  5.11  shall be deposited in the state treasury and credited to the 
  5.12  water recreation account. 
  5.13     Sec. 6.  Minnesota Statutes 1994, section 86B.870, 
  5.14  subdivision 1, is amended to read: 
  5.15     Subdivision 1.  [FEES.] (a) The fee to be paid to the 
  5.16  commissioner: 
  5.17     (1) for issuing an original certificate of title, including 
  5.18  the concurrent notation of an assignment of the security 
  5.19  interest and its subsequent release or satisfaction, is $15; 
  5.20     (2) for each security interest when first noted upon a 
  5.21  certificate of title, including the concurrent notation of an 
  5.22  assignment of the security interest and its subsequent release 
  5.23  or satisfaction, is $10; 
  5.24     (3) for transferring the interest of an owner and issuing a 
  5.25  new certificate of title, is $10; 
  5.26     (4) for each assignment of a security interest when first 
  5.27  noted on a certificate of title, unless noted concurrently with 
  5.28  the security interest, is $1; and 
  5.29     (5) for issuing a duplicate certificate of title, is $4. 
  5.30     (b) In addition to other statutory fees and taxes, a filing 
  5.31  fee of $3.25 $3.50 is imposed on every application.  The filing 
  5.32  fee must be shown as a separate item on title renewal notices 
  5.33  sent by the commissioner.
