  1.1                          A bill for an act 
  1.2             relating to data practices; authorizing the 
  1.3             commissioner of administration to develop and 
  1.4             distribute a comprehensive policy on student records 
  1.5             and other data on school-aged children; appropriating 
  1.6             money. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [COMPREHENSIVE STATE POLICY ON STUDENT RECORDS 
  1.9   AND OTHER DATA ON SCHOOL-AGED CHILDREN.] 
  1.10     Subdivision 1.  [COMMISSIONER OF ADMINISTRATION.] The 
  1.11  commissioner of administration shall develop and distribute a 
  1.12  comprehensive policy that accurately reflects state and federal 
  1.13  data regulations regarding student records and other data used 
  1.14  by government agencies who serve school-aged children.  The 
  1.15  commissioner shall consult with representatives from federal 
  1.16  agencies, state agencies, county governments, school districts, 
  1.17  and cities who have an interest in student records and other 
  1.18  applicable data for school-aged children.  The comprehensive 
  1.19  policy shall include procedures and other guidelines detailing 
  1.20  allowable use and transfer of data according to state and 
  1.21  federal law in at least the following areas: 
  1.22     (1) the use of data transferred between school districts, 
  1.23  and between school districts and state, county, and city law 
  1.24  enforcement and correction agencies; 
  1.25     (2) the content and type of data to be transferred between 
  1.26  school districts, and between school districts and state, 
  2.1   county, and city law enforcement and correction agencies; and 
  2.2      (3) any enforcement mechanisms to support the proper 
  2.3   transfer of data as required by law. 
  2.4      Subd. 2.  [DISTRIBUTE POLICY MANUAL.] The commissioner 
  2.5   shall distribute a comprehensive policy manual containing the 
  2.6   policies described in subdivision 1 to every school district, 
  2.7   county, and city in the state by September 1, 1999. 
  2.8      Subd. 3.  [RECOMMENDATIONS TO THE LEGISLATURE.] By February 
  2.9   1, 2000, the commissioner shall make recommendations to the 
  2.10  legislature regarding necessary clarifications of state law and 
  2.11  any enforcement mechanisms identified as essential for the 
  2.12  proper sharing of data. 
  2.13     Sec. 2.  [APPROPRIATION.] 
  2.14     $....... is appropriated from the general fund to the 
  2.15  department of administration in fiscal year 2000 for developing 
  2.16  and distributing a comprehensive policy manual on student 
  2.17  records and other data on school-aged children. 
  2.18     Any balance in the first year does not cancel but is 
  2.19  available in the second year.  This appropriation is available 
  2.20  until June 30, 2001.
