  1.1                          A bill for an act 
  1.2             relating to agriculture; changing certain shell egg 
  1.3             regulations; amending Minnesota Statutes 2000, 
  1.4             sections 29.23, subdivisions 2, 3, and 4; and 29.237. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2000, section 29.23, 
  1.7   subdivision 2, is amended to read: 
  1.8      Subd. 2.  [EQUIPMENT.] The commissioner shall also by rule 
  1.9   provide for minimum plant and equipment requirements for 
  1.10  candling, grading, handling and storing eggs, and shall define 
  1.11  candling.  Equipment in use before July 1, 1991, that does not 
  1.12  meet the design and fabrication requirements of this chapter may 
  1.13  remain in use if it is in good repair, capable of being 
  1.14  maintained in a sanitary condition, and capable of maintaining a 
  1.15  temperature of 50 45 degrees Fahrenheit (10 7 degrees Celsius) 
  1.16  or less. 
  1.17     Sec. 2.  Minnesota Statutes 2000, section 29.23, 
  1.18  subdivision 3, is amended to read: 
  1.19     Subd. 3.  [EGG TEMPERATURE.] Eggs must be held at a 
  1.20  temperature not to exceed 50 45 degrees Fahrenheit (10 7 degrees 
  1.21  Celsius) after being received by the egg handler except for 
  1.22  cleaning, sanitizing, grading, and further processing when they 
  1.23  must immediately be placed under refrigeration that is 
  1.24  maintained at 45 degrees Fahrenheit (7 degrees Celsius) or 
  1.25  below.  Eggs offered for retail sale must be held at a 
  2.1   temperature not to exceed 45 degrees Fahrenheit (7 degrees 
  2.2   Celsius).  After August 1, 1992, eggs offered for retail sale 
  2.3   must be held at a temperature not to exceed 45 degrees 
  2.4   Fahrenheit (7 degrees Celsius).  Equipment in use prior to 
  2.5   August 1, 1991, is not subject to this requirement.  
  2.6      Sec. 3.  Minnesota Statutes 2000, section 29.23, 
  2.7   subdivision 4, is amended to read: 
  2.8      Subd. 4.  [VEHICLE TEMPERATURE.] A vehicle used for the 
  2.9   transportation of shell eggs from a warehouse, retail store, 
  2.10  candling and grading facility, or egg holding facility must have 
  2.11  an ambient air temperature of 50 45 degrees Fahrenheit (10 7 
  2.12  degrees Celsius) or below. 
  2.13     Sec. 4.  Minnesota Statutes 2000, section 29.237, is 
  2.14  amended to read: 
  2.15     29.237 [UNIFORMITY WITH FEDERAL LAW.] 
  2.16     Subdivision 1.  [SHELL EGGS.] Federal regulations governing 
  2.17  the grading of shell eggs and United States standards, grades, 
  2.18  and weight classes for shell eggs, in effect on July 1, 
  2.19  1990 2000, as provided by Code of Federal Regulations, title 7, 
  2.20  part 56, are the grading and candling rules in this state, 
  2.21  subject to amendment by the commissioner under chapter 14, the 
  2.22  Administrative Procedure Act. 
  2.23     Subd. 2.  [INSPECTION.] Federal regulations governing the 
  2.24  inspection of eggs and egg products, in effect on May 1, 
  2.25  1990 2000, as provided by Code of Federal Regulations, title 7, 
  2.26  part 59, are the inspection of egg and egg products rules in 
  2.27  this state, subject to amendment by the commissioner under 
  2.28  chapter 14, the Administrative Procedure Act.
